Im ersten Teil dieser Arbeit stelle ich die aktuelle gesetzliche Regelung dar und versuche die Legitimierung der Zwangsmaßnahmen im Kontext der Grundrechte zu betrachten.Das zweite Kapitel behandelt die Thematik kritisch, es werden Bewertungen der Zwangsmaßnahmen sowie Erfahrungsberichte beschrieben. Mit dem Einbezug der Rolle der Sozialen Arbeit werde ich das zweite Kapitel abschließen. Es soll erörtert werden, ob die Soziale Arbeit zur Wahrung der Menschenrechte im Zwangskontext der Betroffenen beitragen kann. Beendet wird die Arbeit mit zwei unterschiedlichen Ansätzen: zum einen wie Gewalt und zum anderen wie Zwang im psychiatrischen Kontext vermieden werden kann.Anwendung von Zwang, sei es in Form einer Unterbringung gegen den Willen des Patienten, sei es in Form einer Zwangsmaßnahme wie Zwangsmedikation, Fixierung oder Isolierung, stellt im Zusammenhang mit einer stationären psychiatrischen Behandlung unzweifelhaft eines der ethisch schwierigsten und ältesten Probleme der Psychiatrie dar.
