Druck auf Anfrage Neuware - Printed after ordering - Luís Greco wirft in der vorliegenden Publikation die Frage auf, ob die heutige strafrechtstheoretische Diskussion von Feuerbach und seiner psychologischen Zwangstheorie lernen kann. Dem Autor zufolge hat Feuerbach durch seinen Versuch, das Gesetzli…chkeitsprinzip als Mittel zur wirksamen Abschreckung zu begründen, einen Kategorienfehler begangen, weil er eine Schranke der Staatsmacht auf eine Zweckmäßigkeitsüberlegung zurückführt. Nach der Klärung des Verhältnisses von Feuerbach zu Kant und nach einer Widerlegung der Annahme, wonach Feuerbach vom psychologischen Modell eines berechnenden Täters ausgegangen sei, wendet sich Greco hauptsächlich der heutigen strafrechtstheoretischen Diskussion zu. Vorgezogen wird eine negativ-generalpräventive Theorie weitgehend nach Feuerbach'schem Vorbild, die aber nicht mehr den Anspruch erhebt, Schranken der Staatsmacht zu begründen. Diese, vor allem das Instrumentalisierungsverbot und das Gesetzlichkeitsprinzip, werden auf eine eigenständige Grundlage gestellt.; Dissertationsschrift.
