This innovative study regards National Socialist criminal law-in accordance with the theories of continuity and radicalisation-as the racist (anti-Semitic), nationalistic (Germanic) and totalitarian updating of the authoritarian and anti-liberal tendencies found in German criminal law at the… turn of the 20th century and during the Weimar Republic. The author proves this thesis through systematic analysis of the works of relevant authors, focusing primarily on the texts, which speak for themselves, rather than on morally judging the people who wrote them. In doing so, he also examines the reception of German (National Socialist) criminal law in Latin America. The aforementioned continuity did not only exist from a past perspective (post-Weimar), but also from a forward-looking perspective ('the Bonn Republic' 1949-1990). In short, neither did National Socialist criminal law appear from nowhere, nor did it completely disappear after 1945, which has seamlessly led to the modern-day attempt to reconstruct the identity of this Germanic myth through the so-called 'neue Rechte' or 'New Right' political movement. Por esta razón, la misión y las competencias de los fiscales var¡an de un tribunal a otro. La cuestión primera y fundamental Âûa simple vista- parece residir…en si el fiscal tiene un papel acusatorio o, por lo contrario, de funcionario de justicia imparcial que tiene que investigar por igual las circunstancias inculpatorias y exculpatorias. Si se opta Âû como lo hace el Estatuto de la ICC Âû por este último enfoque, se plantea la cuestión de cómo poner en práctica este objetivo id¡lico, y en particular cómo se sanciona a un fiscal que no logra cumplir con estas altas expectativas. Una segunda cuestión de importancia tiene que ver con el alcance del control judicial en la fase de investigación. Hasta ahora los modelos adoptados van desde ninguna supervisión judicial (Núremberg y Tokio) hasta investigaciones acompa?adas de un juez (Tribunales ad hoc e ICC) y la designación de un juez instructor que controla y dirige las investigaciones bajo su autoridad (ECCC). A pesar de estas y otras diferencias, todos los tribunales internacionales e internacionalizados comparten una caracter¡stica común: fusionan elementos de la tradición romano-germánica y del common law que dan lugar a un Derecho procesal sui generis. Aunque como se dijo anteriormente no existe aún un único procedimiento penal, s¡ se han sentado las bases y el punto de partida para lograrlo en a?os venideros.
