Si el fascismo había sido el régimen de la ilegalidad desplegada, una legalidad republicana no solo debía ser considerada fundamento esencial de la libertad, sino que tendría que ser también «una legalidad capaz de modificar todas las leyes menos las puestas a priori como condiciones necesarias para el respeto de la libertad». El principio y valor de la legalidad en sus diversas implicaciones es el eje en torno al cual gira la peripecia teórica del gran procesalista y también constitucionalista que fue Piero Calamandrei: «el tema/problema de toda su vida de jurista», según se ha dicho.
