Para el encuadre dogmático del tratamiento concursal de los créditos extracontractuales, se analiza la necesidad de tutela específica del acreedor involuntario en el concurso, centrándose en cuestiones generales relativas a la función del derecho concursal como mecanismo tuitivo de acreedores especialmente desfavorecidos y, más concretamente, en la fundamentación jurídica de la preferencia concursal del crédito extracontractual. A continuación se analiza la evolución histórica de la legislación concursal española y se describe el sistema de tutela preferencial del crédito extracontractual en la vigente Ley Concursal, delimitando el ámbito objetivo de aplicación del privilegio concursal. . . El sistema previsto en la norma concursal es objeto de análisis y crítica, especialmente por las dificultades del actual sistema para ofrecer una tutela adecuada a los acreedores extracontractuales en casos de daños desproporcionados. En superación de las insuficiencias de la solución legal, el estudio propone la introducción de mecanismos novedosos para la distribución del patrimonio de responsabilidad entre todos los acreedores extraconcursales. . . Desde una perspectiva funcional, los dos últimos capítulos del estudio construyen el régimen jurídico aplicable a los acreedores involuntarios en del concurso, diferenciando su tratamiento como créditos concursales o créditos contra la masa, y abordando cuestiones complementarias, como la delicada situación en el concurso del asegurador, la posible participación de los acreedores involuntarios en la administración concursal, o la necesidad de aseguramiento de la responsabilidad civil tras la declaración de concurso. El estudio, en general, apunta soluciones posibilitadoras de una más efectiva tutela de los créditos extracontractuales. . . The extent to which the Court of Justice (ECJ) has supported or rather constrained its development has been… intensely debated by academics and practitioners alike. After the slow development of a seemingly permissive approach, the ECJ case law reached an apparent turning point a decade ago in the often criticised judgments in Rüffert and Laval, which left a number of open questions. The more recent judgments in Bundesdruckerei and RegioPost have furthered the ECJ case law on socially orientated smart procurement and aimed to clarify the limits within which Member States can use it to enforce labour standards. This case law opens up additional possibilities, but it also creates legal uncertainty concerning the interaction of the EU rules on the posting of workers, public procurement and fundamental internal market freedoms. These developments have been magnified by the reform of the EU public procurement rules in 2014. This book assesses the limits that the revised EU rules and the more recent ECJ case law impose on socially-orientated smart procurement and, more generally, critically reflects on potential future developments in this area of intersection of several strands of EU economic law.
