Eine rein juristische Perspektive oder eine ausschließlich personalmanagementorientierte Betrachtung wird den Praxisanforderungen nur unzureichend gerecht. Dieses Buch ist als perspektivenintegrierender Basistext für Nicht-Ökonomen und Nicht-Juristischen leicht verständlich. Es kann zudem für einführende Vorlesungen und Seminare sowohl im Bereich Arbeitsrecht wie auch im Bereich Personalmanagement eingesetzt werden. Die dem Text zugrunde liegende didaktische Konzeption ist von den Autoren in verschiedenen Lehrveranstaltungen erprobt und evaluiert worden. Den Ausgangspunkt des Buchs bildet die Betrachtung der Funktionen des Rechts (Regeln für Standardsituationen, Regulation von Herrschaft). In diesem Kontext wird dann der Schutz der Arbeitnehmer als strukturell unterlegener Partner durch staatlich durchgesetztes öffentliches Recht und verbindliche gesetzliche Mindeststandards für Arbeitsverträge, sowie die Stärkung der Arbeitnehmerseite durch kollektive Elemente (Tarifvertrag, Betriebsverfassung) vorgestellt. Die Unternehmensführung hat bei der Gestaltung des Wertschöpfungsprozesses darüber zu entscheiden, wie und in welcher Form menschliche Arbeit integriert werden soll. Auf arbeitsrechtlicher Ebene werden in diesem Zusammenhang auf Werk-, Dienst- und Arbeitsverträge eingegangen. Die Personalmanagementaufgaben werden dann in ihrer Bedeutung für den Wertschöpfungsprozess aus einer politisch-strategischen, einer personalwirtschaftlichen und einer arbeitsrechtlichen erspektive betrachtet. Dabei werden die Bereiche Personalbeschaffung, Leistungserstellung, Personalbeurteilung, Vergütung, Personalentwicklung und Personalfreisetzung angesprochen.
