Vor dem Hintergrund einer sich intensivierenden und beschleunigenden 'Europäisierung des Strafrechts' wird in diesen Beiträgen die Frage diskutiert, ob die weit reichende Umgestaltung des nationalen Rechts jeweils noch im Einklang mit den die Nationen übergreifenden und zugleich den nationalen Rechtsordnungen vorausgehenden Grundsätzen des Rechtsstaates stehen. Denn ohne Berücksichtigung dieser Grundsätze wird die weitere 'Europäisierung des Strafrechts' (wie etwa im Bereich des europäischen Haftbefehls) auf zunehmenden Widerstand stoßen - und dies zu Recht. Polen und Deutschland sind dabei zwei Beispiele, die einerseits als ein 'neues' und andererseits als ein 'altes' Land der europäischen Gemeinschaft unterschiedliche Erfahrungen und Perspektiven in diese Debatte einbringen können. Die Autoren diskutieren zunächst die Grundlagen einer 'Europäisierung des Strafrechts' und wenden sich dann mehreren Spezialproblemen dieses Themenkomplexes zu, wobei es sowohl um Fragen mit materiell-rechtlichem als auch um solche mit prozessrechtlichem Ausgangspunkt geht.
