Paperback. Condition: New. The importance of the rule of law is universally recognised and of fundamental value for most societies. Establishing and promoting the rule of law in the Muslim world, particularly in the Middle East, North Africa, and Central Asia, has become a pressing but complicated issue. These states have Muslim majority populations, and the religion of Islam has an important role in the traditional structures of their societies. While the Muslim world is taking gradual steps towards the establishment of rule of law systems, most Muslim majority countries may not yet have effective legal systems with independent judiciaries, which would allow the state and institutions to be controlled by an effective rule of law system. One important aspect of the rule of law is freedom of expression. Given the sensitivity of Muslim societies in relation to their sacred beliefs, freedom of expression, as an international human rights issue, has raised some controversial cases. This book, drawing on both International and Islamic Law, explores the rule of law, and freedom of expression and its practical application in the Muslim world.…

Hardcover. Condition: Very Good. Dust Jacket Condition: Very Good. 2024 OUP hardcover edition. Light reading wear else very good condition. Contemporary research on the genealogy of human rights and the foundations of international law has brought renewed interest to the study of natural law in the early-modern period. German-born Samuel Pufendorf (1632-1694) is one of the eminent thinkers of this tradition, shaping the period's natural jurisprudence. This unique collection of essays edited by historian of political thought Peter Schröder fills in a gap in Pufendorf scholarship, exploring the significance of his contributions to political and legal thought on a broad scale. While many books studying Pufendorf's work are confined to one specific academic area, Pufendorf's International Political and Legal Thought is truly interdisciplinary, and the first book to substantially address the international aspect of Pufendorf's work. Ambitious and accessible, this collection is indispensable for scholars and students of intellectual history, political thought, international legal history, the Enlightenment, and political economy. With its focus on international law, Pufendorf's International Political and Legal Thought is a critical addition to the existing body of work on this renowned philosopher and jurist.…

Taschenbuch. Condition: Neu. Neuware - Damages in Investor-State Arbitration: Current Issues and Challenges addresses specificities of the assessment of damages in investor-state disputes, reflecting the tensions between the sovereignty and self-determination of states and their legal obligations towards foreign investors. These tensions are primarily present in the context of compensation for expropriation, but other commitments of host states undertaken in bilateral investment treaties and contracts with foreign investors may also be in conflict with changing political and economic circumstances. With this background, the calculation of damages becomes a complex endeavor in each case. The lack of valuation principles that are uniformly accepted and implemented leads to uncertainty and unpredictability in practice. The present analysis tries to identify the most important issues and challenges, such as the choice of the valuation date, appropriate valuation methods, moral damages, and the awarding of interest.…

Hardcover. Condition: Very Good. 2010 OUP hardcover edition. Unread copy in very good condition. Investment treaty arbitration has a hybrid nature combining public international law (as regards its substance) with elements of international commercial arbitration (mainly as regards procedure). However, in essence and function it deals with a special, internationalised form of judicial review of governmental conduct that is more akin to the judicial control of governmental action provided for by national administrative and constitutional law than to either classic inter-state dispute resolution or international commercial arbitration. This has been recognised in some academic writing and several awards, where reference to national administrative law concepts and principles of international law-based judicial review of governmental action, such as international trade or human rights law, is used to help specify and apply the open-ended concepts of investment treaties. In-depth conceptualization is however often lacking. The current study is the first, pioneering effort to bring these under-developed ad hoc references to comparative and international administrative law concepts into a deeper theoretic and systematic framework. …

Hardback. Condition: New. 1st. Winner of the 2022 International Academy of Astronautics (IAA) Social Sciences Book AwardImpacts by asteroids or comets on Earth may lead to natural disasters of catastrophic dimensions, one of the most devastating having caused the extinction of the dinosaurs 66 million years ago. Space agencies and other actors are increasingly dedicated to the development of technology to predict and mitigate such risks. This book addresses legal and policy aspects of 'planetary defence' activities aiming at the mitigation of Near-Earth Objects (NEO) impact threats. These include responsibility and liability for damage caused by such activities (or their failure) as well as international cooperation and possible decision making processes.…
