Reprint. Condition: Gut. pp. 256-292. From the library of Prof. Wolfgang Haase, long-time editor of the ANRW and the International Journal of the Classical Tradition (IJCT). - With dedication by the author to W. Haase. - Author's name handwritten on cover, otherwise clean. - From the text: When enumerating the sources of Roman law the jurists Gaius, Pomponius, and Papinian did not unclude res iudicatae, judgements in earlier cases to be used as precedents, in their lists of sources. Similarly, in the Roman juristic literature judicial precedents, aside from those set by the emperors, have only a slight role. Thus the standard doctrine of Roman law is that expressed by Justinian, non exemplis sed legibus iudicandum est. The papyri from Egypt of the principate, however, show a striking contrast. Attention was first given the matter about sixty years ago when EgonWeiss observed that in the papyri in which a question of law is raised, the most common documents cited are not statutes or edicts, but decisions in earlier cases. Later H. F. Jolowicz reviewed the question and concluded that there existed a definite practice of citing decided cases as authority in courts of law, that judgements were sometimes expressly based on such authority, and that the practice was facilitated by the use of official dairies and collections made from the reports that they contained. But it is unlikely that there was much in the way of a theory of case law. Sprache: Englisch Gewicht in Gramm: 550.
Hardcover with Dust Jacket. Condition: VERY GOOD. Dust Jacket Condition: Very Good. 248pp. Sewn binding in cloth, gilt spine lettering. Ex-library; exceedingly clean and sharp with sound binding and no evidence of use. Shipped professionally in a box. 'The discovery in the Judaean desert between 1951 and 1961 of documentary papyri from the period of the Bar-Kochba Revolt in the early second century opened for the first time a window on the lives of Jewish lay people on the periphery of Judaea in a critical period of history. By the year 2000 these texts were published in full. Of particular interest was the light they shed on the interplay of Jewish, Greek and Roman law in the Roman provinces of Judaea and Arabia. In the current volume leading scholars from Europe, America and Israel debate the major questions raised by these texts and offer new insights into the material and its implications.' Condition: Wie Neu. Zustandsbeschreibung: leichte Lagerspuren/minor shelfwear. Edited by Albert I. Baumgarten, Hanan Eshel, Ranon Katzoff & Shani Tzoref. 14 contributions by Moshe Benovitz, Vered Noam, Eyal Regev, Lawrence H. Schiffman, Aharon Shemesh, Hanan Eshel, Steven D. Fraade, Shamma Friedman, David Goodblatt, Yonatan Adler, Chaim Ben David, Tal Ilan, Ze'ev Safrai, Chana Safrai and Guy D. Stiebel; organized in three chapters: 1. Halakhah and the Scrolls from Qumran; 2. Halakhah and Quotidian Documents from the Judean Desert; 3. Halakhah and Epigraphic Sources. - Epigraphic finds, here interpreted broadly to include papyri, scrolls, and the like, have immeasurably enriched our knowledge of the ancient Jewish past while at the same time posing a challenge to modern scholarship: how does one integrate old knowledge, based on previously known sources, with new information? We now recognize that Rabbinic texts are normative: they tell us how their authors believed life should be lived, rather than the details of ordinary, everyday, experience. What weight, then, should be given to traditional halakhic texts in evaluating the contents of newly discovered written remains? And what light can be shed by these new finds, especially those inscriptions and documents that record small moments of ancient Jewish life, upon the long-familiar normative texts? The conference on "Halakhah in Light of Epigraphy" was intended to generate discussion on these broad issues, as well as to provide a forum for exploration of specific matters of halakhah reflected in the epigraphic sources. The papers in this volume tend to emphasize the centrality of halakhah in ancient Judaism. Proceedings of a conference at Bar-Ilan University, May 2008. 303 Seiten mit 16 Abb., gebunden (JAJ.S - Journal of Ancient Judaism. Supplements; Vol. 3/Vandenhoeck & Ruprecht 2011). Statt EUR 89,00. Hardback. Condition: New. The present volume presents a selection of studies by Ranon Katzoff on Jews in the ancient Roman world. Common to them is that they deal with Jews in liminal situations - confronted with non-Jewish, mainly Roman, laws, places, government, and modes of thought. In these studies - in which texts in Greek and Latin and rabbinic texts (all in translation) elucidate each other - Jews are shown to be rather loyal to their Jewish traditions, a controversial conclusion. The first two sections concern law. Section one searches the remains of popular Jewish culture for evidence on the degree to which rabbinic law really prevailed, through the study of Judaean Desert documents, mainly those of Babatha. Section two sifts through rabbinic law for traces of Roman law. Section three comprises studies of Jews in, to, and from the city of Rome, and section four a miscellany of studies on Jews confronted with non-Jewish life.
