Hierbei wird herausgearbeitet, dass die Machtbalance im aktienrechtlichen Systemgefüge auf Kosten des Minderheitenschutzes und der objektiven Legalitätskontrolle durch das ARUG empfindlich gestà rt wird, ohne dass der Missbrauch des Aktienrechts verhindert oder entscheidend eingedämmt werden kà nnte.
