Gardien de l'égale application de la loi pénale, le juge a aujourd'hui la haute main sur les procédures répressives. L'Exécutif conserve pourtant, dans ces procédures, un rôle qui n'est pas celui d'un simple auxiliaire dénué de pouvoirs propres. La police judiciaire, en dépit de son nom, n'est que partiellement soumise à l'autorité judiciaire ; le " cordon ombilical " entre le parquet et le gouvernement n'a pas été coupé ; la grâce du président de la République reste toujours autant sollicitée et octroyée ; les techniques de répression administrative permettent à l'administration de prononcer elle-même des sanctions, sans avoir à les demander au juge Ces exemples montrent que l'Exécutif est bien présent en matière pénale. Mais il n'est pas non plus omniprésent : rien n'autorise à céder aux facilités d'une description à l'emporte-pièce qui ferait de l'Exécutif, au-delà des apparences, le seul véritable maître de la répression. L'étude du droit en vigueur, au croisement du droit public et du droit pénal, donne plutôt l'image nuancée d'un jeu constant de concurrence et de collaboration des pouvoirs. On ne saurait juger du bien-fondé ou du mal - fondé de l'action répressive de l'Exécutif avant d'avoir compris les modalités de ces interactions. Ce sont les voies du droit. Des voies menant vers plus de souffrance et plus de lois, ou retrouvant le sens et le respect du droit ? Question pressante pour le juriste, qui voit surgir ici on là des signes avant-coureurs de bouleversement. Le plus visible est l'accroissement en nombre. Il se mesure d'abord aux normes juridiques produites. Egalement à la multiplication des lieux où se dit et se fait le droit : nationaux, infra - et supranationaux. Quand il s'y ajoute d'autres phénomènes, de nouvelles techniques de communication par exemple, la conception traditionnelle, immobile, unidimensionnelle, hiérarchisée, s'en trouve bousculée, révélant peut-être une mutation des logiques. A l'horizon, d'autres figures possibles, des modèles relevant d'une autre cohérence : mobiles, pluridimensionnels, aléatoires. Autant de vérités que chacun est amené à saisir à travers sa discipline et son itinéraire propres.
