La presente publicación en castellano, con muchos cambios y actualizaciones, incluso en el sistema de notas, del manual en italiano Sistemi costituzionali (Giappichelli, Torino, 2ª ed. 2024) pretende llenar un vacío en la producción académica de España (y de Abya Yala-América Latina, aunque, en este continente, publicamos hace unos años una obra en dos volúmenes titulada Derecho constitucional comparado, I, Sistemas constitucionales, traducida también al portugués-brasileño, y acompañada de otros volúmenes dedicados al método comparado, a las fuentes del Derecho y la Constitución, y a la justicia constitucional). España paga un pesado tributo a la ausencia de disciplinas comparadas en la universidad, lo que la distingue de la mayoría de los países europeos. Con raras excepciones, los escasos cursos impartidos se dedican en su mayoría al estudio de unos pocos sistemas jurídicos occidentales más conocidos. Tampoco existen manuales españoles de Derecho comparado, como los que caracterizan la producción alemana, francesa, italiana y de otros países. Incluso la célebre obra de García Pelayo no es más que una recopilación de Derechos extranjeros, que es muy distinto del Derecho comparado. A lo sumo, junto a algunas traducciones de manuales de Derecho privado comparado, especialmente alemanes y franceses (por ejemplo, David y Zweigert-Kötz, traducidos en Latinoamérica), sólo circulan en castellano antiguas ediciones de manuales italianos de Derecho constitucional comparado (Biscaretti di Ruffia y de Vergottini). Hace excepción el manual de Derecho constitucional comparado coordinado por López Garrido, Massó Garrote y Pegoraro (Valencia, 2017), que sin embargo a su vez no se libera, salvo en unos pocos capítulos, de la perspectiva estrictamente eurocéntrica y metodológicamente conservadora que caracteriza a los estudios constitucionales ?domésticos? Francisco Javier Díaz Revorio trata de explicar las razones de esta ausencia en una larga entrevista aparecida en Diritto pubblico comparato ed europeo, n. 2, 2019; como también lo hace Clara Souto Galván en el n. 33, 2023 de la Revista general de Derecho público comparado, en la sección monográfica dedicada 24 Prefacio a la edición española a ?Profesores y Universidades. El influjo del formante doctrinal y su influencia en el estudio institucional del Derecho comparado? (Para América Latina, véase el artículo de Nilda Garay; para Brasil, Manuellita Hermes). Lo que nuestros amigos y colegas españoles encuentran más difícil de justificar es una cierta resistencia cultural al cambio que perciben, y que parece alimentada por un aplanamiento generalizado sobre las teorías ?principalmente alemanas, pero también francesas e italianas? que propugnan un universalismo ?euroatlántico-céntrico? y ?globalizador? bastante insensible al pluralismo socioeconómico y jurídico que se le opone y que representa el caldo de cultivo de la verdadera comparación. De ahí la decisión de publicar también en España una obra que, a la inversa ?al combinar la Teoría general con el Derecho comparado, como preconiza Guillaume Tusseau?, puede servir de base crítica en la dirección de la apertura hacia una ciencia bisagra entre los Derechos positivos y la abstracción teórica, liberándose de los dogmas de homogeneización propuestos sobre todo en los foros internacionales y en los Tribunales constitucionales europeos, para poner de relieve la variedad ?democrática? de las opciones en todas las culturas y tradiciones jurídicas, en el tiempo y en el espacio.…
