Trotz scharfer Kritiken und vieler Versuche ihn zu beseitigen und zu durchbrechen, wird er bis heute noch als die besondere Eigenschaft des BGB gesehen. Vielen Studierenden bereitet der abstrakte dingliche Vertrag Schwierigkeiten, wobei aber ein richtiges Verständnis auch die Beherrschung von dem Begriff des Rechtsgeschäfts, der Trennung zwischen dem Schuld- und Sachenrecht, dem Bereicherungsrecht sowie dem Institut des gutgläubigen Erwerbs fà rdert. Somit wird eine gute Grundlage für das Studieren des Zivilrechts geschaffen. Es ist allgemein anerkannt, dass China das deutsche Zivilrecht mittelbar durch das taiwanische und japanische Recht rezipiert hat. Dennoch lehnt die herrschende Meinung in der chinesischen Literatur den abstrakten dinglichen Vertrag ab, weil er auÃer seiner Lebensfremdheit auch das Eigentümersinteresse beeinträchtige. AuÃerdem wird behauptet, dass er unnà tig sei, da seine Funktion, Verkehrsinteresse zu schützen, durch den Gutglaubensschutz übernommen werde. Insbesondere ist es im franzà sischen Recht mà glich, auch ohne Anerkennung eines solchen Vertrags Geschäfte reibungslos abzuwickeln. Auch wenn manche chinesische Wissenschaftler den dinglichen Vertrag annehmen, bleibt es weiterhin umstritten, ob die Einigung selbst oder erst die Einigung und Eintragung bzw. Ãbergabe zusammen als dinglicher Vertrag bezeichnet werden soll. In dieser Abhandlung wird einerseits eine ausführliche Erläuterung des abstrakten dinglichen Vertrags vorgenommen, also von seiner geschichtlichen Entwicklung über seinen Tatbestand aus dinglicher Einigung und Eintragung bzw. Ãbergabe bis zur Widerlegung der Kritiken. Andererseits ist zu erläutern, ob der abstrakte dingliche Vertrag im chinesischen Zivilrechtsystem, welches dem deutschen ähnelt, existiert. Falls dies nicht der Fall sein sollte, dann stellt sich die Frage, ob das chinesische Zivilrecht aus irgendeinem Grund den abstrakten dinglichen Vertrag anerkennen sollte.…
