Der Anstoà zu dieser Untersuchung ergab sich aus der bisher noch nicht hinreichend fundierten Operationalisierung des psychologischen Konstrukts und juristisch vorrangigen Zuordnungsmerkmals "emotionale Bindung" als quasi psycho…logische Dimension des "Kindeswohls" im Rahmen von Sorgerechtsentscheidungen nach Ehescheidungen und Trennungen am Familiengericht (§1671 BGB). Inwieweit ist die vorrangige Gewichtung des Kriteriums "emotionale Bindung" bei Sorgerechtsentscheidungen wissenschaftlich zu rechtfertigen, d. h. wie wirkt sich diese psychologisch auf das "Wohl des Kindes" aus? Damit einhergehend muss auch der juristische Terminus "Kindeswohl" aus Sicht der Wissenschaft Psychologie hinreichend präzisiert werden. Für eine kindzentrierte und systemische Sorgerechtsentscheidung ist es notwendig, dass alle bestehenden Bindungen des Kindes im Familiensystem beziehungsqualitativ bewertet werden müssen und eine Sorgerechtsentscheidung von allen Beteiligten gemeinsam, insbesondere von beiden Elternteilen und den von Ehescheidung bzw. Trennung betroffenen Kindern, in einem geduldigen Konfliktlà sungsprozess selbst erarbeitet wird. Gefragt ist hierbei im Dialog nicht zuletzt die moderierende Unterstützung eines familientherapeutisch geschulten Psychologen oder Mediators. Er muss als "Anwalt des Kindes" beraten und "das Wohl des Kindes schützen" (KJHG-SGB VIII, 1991). Frank Teuteberg erarbeitet eine sehr umfassende und integrative Analyse des Forschungsstandes, ausgehend von der tiefenpsychologisch fundierten "Bindungstheorie" über die empirisch-psychologische Grundlagenwissenschaft bis hin zu personzentrierten, systemischen und prozess-orientierten Perspektiven. In der abschlieÃenden Bewertung kann nachgewiesen werden, dass der "emotionalen Bindung" ein primärer Stellenwert im Prozess seelisch-gesunder Kindesentwicklung und Individuation zukommt. Die Ergebnisse dieses Buches korrespondieren mit der zum 1. Juli 1998 in Kraft getretenen Reform des Kindschaftsrechts, wonach die Rechte der Kinder gestärkt, die gemeinsame Sorge der Eltern zum Regelfall und das Umgangsrecht erweitert werden sollen. Frank Teuteberg wendet sich an Mediatoren, Familienrichter und psychologische Gutachter, an Psychotherapeuten, Mitarbeiter von Familien- und Erziehungsberatungsstellen und nicht zuletzt an die von Scheidung betroffenen Eltern.
