In dieser Studie werden die rechtlichen Grundlagen für die Erzeugung von Emissionsminderungsgutschriften durch nationale Ausgleichsprojekte untersucht und deren umweltà konomischer Gehalt bewertet. Es werden die Chancen und Risiken…eines Mechanismus für nationale Ausgleichsprojekte mit europarechtlichem Bezug ebenso untersucht wie jene ohne europarechtlichen Bezug. Für eine genaue Einordnung des Untersuchungsgegenstandes auf internationaler, europäischer und nationaler Ebene wird ein Ãberblick über die Entwicklung des internationalen Klimaschutzes bis in die heutige Zeit gegeben und mit nationalen Ausgleichsprojekten vergleichbare Mechanismen in den globalen Bemühungen und Handelssystemen aufgezeigt. Hier zeigte sich, dass es zwar Ãhnlichkeiten z. B. in Australien oder Japan zu dem hier gegenständlichen Untersuchungsgegenstand gibt, dass ein solcher Mechanismus aber nicht auf internationaler Ebene angelegt ist und es zu keinen Wechselwirkungen zu den hier thematisierten nationalen Ausgleichsprojekten mit europarechtlichem Bezug kommt. Auf internationaler, europäischer und nationaler Ebene wurden verschiedene in Betracht kommende Rechtsgrundlagen untersucht und hierbei dargelegt, welche rechtliche Grundlage für die Erzeugung von Emissionsminderungsgutschriften durch nationale Ausgleichsprojekte in Betracht kommt. Hierfür wurde eine eigene Definition für nationale Ausgleichsprojekte und ihnen entspringende Emissionsminderungsgutschriften entwickelt und ein Bezug zu den bekannten projektbasierten Mechanismen hergestellt. Die Grundlage bildete nicht eine Ãberprüfung der rechtmäÃigen Emissionshandelsrichtlinie am MaÃstab des Gemeinschaftsrechts, da eine solche Ãberprüfung bereits mehrfach Gegenstand wissenschaftlicher Arbeiten und Dissertationen war. Vielmehr wurden aktuelle Ãnderungen der Emissionshandelsrichtlinie auf Grundlage der durch die Luftverkehrsrichtlinie geänderten Fassung, auf Grundlage der in der durch die Ergänzungsrichtlinie geänderten Fassung sowie auf Grundlage der durch die Verordnung 219/2009/EG geänderten Fassung untersucht. Es konnte aufgezeigt werden, dass diese Ãnderungen und Ergänzungen der Emissionshandelsrichtlinie - insbesondere die, die auf der Luftverkehrsrichtlinie fuÃen - keine Rechtswidrigkeit der Emissionshandelsrichtlinie selbst zur Folge haben, denn die Einbeziehung des internationalen Luftverkehrs in das EU EHS ist rechtmäÃig. So kà nnen schon dem Grunde nach keine Einflüsse auf die europarechtlichen Grundlagen für nationale Ausgleichsprojekte wirken, die durch die Ãnderungen und Ergänzungen der Emissionshandelsrichtlinie hätten im Hinblick auf die in der Richtlinie angelegte rechtliche Grundlage für einen Mechanismus nationaler Ausgleichsprojekte entstehen kà nnen. Auch der umweltà konomische Gehalt nationaler Ausgleichsprojekte wurde analytisch bewertet. Hierfür wurden die Chancen und Risiken eines Mechanismus für nationale Ausgleichsprojekte mit europarechtlichem Bezug analysiert und Vorschläge für eine konkrete Ausgestaltung des Mechanismus gegeben. Für eine umweltà konomische Bewertung wurden verschiedene erà rtert und in Bezug zu nationalen Ausgleichsprojekten auf der Grundlage der herausgearbeiteten Definition gesetzt. Aus rechtlicher und umweltà konomischer Sicht konnte aufgezeigt werden, dass ein Mechanismus nationaler Ausgleichsprojekte einen wichtigen Beitrag leisten kann, um die in der Bundesrepublik Deutschland, bzw. in den europäischen Mitgliedstaaten angestrebten Reduktions- und Emissionsbegrenzungsverpflichtungen zu erreichen. Darüber hinaus kann er katalytische Anknüpfungspunkte auf internationaler Ebene bieten, um bestehende Initiativen miteinander zu verbinden, den Abschluss eines internationalen Abkommens weiter voranzutreiben und dazu beitragen, den uns anvertrauten Garten von Eden zu hüten.
