Wegmarke vom 18. ins 19. Jahrhundert! - Schweppe verfasste sein Werk an der Schnittstelle von historischer Rechtsschule und älterer Literatur. In seinem… Vorwort verweist er auf die ältere Literatur: ".umgekehrt ist recht eigentlich dabei vorausgesetzt, daß dem Leser die Schrift von Bach über die äußere und von Heineccius für die innere Rechtsgeschichte, so wie der Hauboldsche Abriß für die Litteratur, immer zur Hand sind.". Die nachfolgenden Auseinandersetzungen mit Gustav Hugo bedauert Schweppe: "Jeder, der mich kennt, weiß, daß ich Niemanden anfeinde.". Dabei rügt er den jungen Puchta, der "über meinen Streit mit dem Herrn Hugo auf eine sehr vorlaute und zudringliche Weise seine Stimme abgegeben.". - Schweppe (1783-1829) studierte seit 1800 in Göttingen, promovierte dort als Schüler von Hugo und wurde Privatdozent. Seine Ernennnung zum Extraordinarius erfolgte 1805 in Kiel, wo er 1814 zum Ordinarius für römisches Recht ernannt worden ist. Im Jahre 1818 kehrte er auf einen Lehrstuhl nach Göttingen zurück.

Pandektistik, 146) ISBN 978-3-8357-1053-5 Nachdruck der letzten Ausgabe des Hauptwerkes des Nienburger Juristen (1783-1829), der in Göttingen seine Karriere begann, 1805 als ausserordentlicher Professor nach Kiel , 1818 nac…h Göttingen berufen wurde, und 1822 an das Oberste Gericht der Hansestädte nach Lübeck wechselte. Das Werk erschien zuerst 1804 in Göttingen und war als bloßer "Abriss" des Römischen Rechts konzipiert, erlebte als solches aber immerhin Nachdrucke 1806 und 1812 (in Kiel). Es lehnte sich wesentlich an Hugo an. 1819 und 1822 erschienen die 2. und 3. Auflage, nunmehr als Lehrbuch. Alle 3 Ausgaben wurden von den Zeitschriften überwiegend gut aufgenommen, wie S. in der Vorrede zum ersten Band berichtet. Alle drei Auflagen wurden als Leitfaden zu Vorlesungen in Kiel, Göttingen, Erlangen, Würzburg, Halle, Jena, Tübingen, Marburg, Basel und Leipzig viel gebraucht. Mit der vorliegenden 4. Auflage erhilt das Werk wiederum eine neue Qualität: da es Lehrbücher genügend gab (Thibaut, Günther, Bucher, Hufeland, Haubold, Warnkönig, Seuffert, Wening-Ingenheim, Mühlenbruch), wollte S. nunmehr ein Handbuch vorlegen, ein Kompendium des römischen Rechts für Lehre und Praxis. Dies verlangte einen anderen Umgang mit den Quellen und eine andere Ordnung als bisher. "Zu dieser quellenmäßigen Behandlung gehört auch die Sonderung der Römischen und neueren Terminologie, und die genauere Bestimmung des Römischen Sprachgebrauchs, welche für die Interpretation der Quellen so wichtig ist .". Ab Band 3 mußte das Werk von Wilhelm Mejer fortgeführt werden, der sich bemühte, das System Schweppes weiterzuführen. Er hat nur an wenigen Stellen Schweppe abweichend interpretiert, so z.B. bei der Lehre von den Noterben, bei der er Heise folgen zu müssen glaubte. M. betont im Vorwort zum letzten Band, er habe sich bemüht, die Terminologie zu verbessern, in seinen Worten "unechte Kunstwörter, insbesondre auch die aus mehreren Worten zusammengesetzten unrömischen Ausdrücke, zu bezeichnen". Welche die "wahren Kunstausdrücke der römischen Juristen" gewesen seien, bleibe weiterer Forschung vorbehalten. Schweppe wurde auch bekannt durch sein "System des Concurses der Gläubiger" (3. Auflage 1829) sowie seine "Römische Rechtsgeschichte und Rechtsaltertümer" (3. Auflage posthum 1832). Letztere wurde seiner Ansicht nach von Puchta übrigens in "auf eine sehr unlöbliche Weise" rezensiert, derart daß S. beschloß, zwischen diesem und sich eine "Scheidewand" für immer zu ziehen (Vorwort Band 1, S. XIX).
