  • CINUS DE PISTORIO (ca. 1270 - 1336 oder 1337) Mit Cinus aus Pistoia beginnt die Epoche der Kommentatoren (oder Postglossatoren). Sein berühmtester Schüler, BARTOLUS de Saxoferrato (1313/14-1357), stellt zugleich den Höhepunkt dieser Kommentatorenzeit dar. Cinus wurde berühmt, weil er mit den großen italienischen Dichtern Francesco Petrarca und Dante in freundschaftlichen Kontakt stand. Petrarca und auch Bocaccio sollen seine Vorlesungen besucht haben. Dante widmete ihm sogar ein Sonett. Sein Codexkommentar, feinsinnig und elegant verfasst, zählt zu den besten zum Codex Iustinianus überhaupt. Ruhm erlangte er auch, weil er nicht wie die meisten seiner Zeit Wiedergaben von Vorlesungen war, sondern ein als eigen-ständiges Buch verfasster Kommentar war. Allegationen dieses Kommentars finden sich bis in das 18. Jahrhundert hinein, auch im Usus modernus Pandectarum in Deutschland. Coing, Handbuch I, 274; Savigny VI, 71-97; L. Chiapelli, Vita e opere giuridiche di Cino da Pistoia con molti docu-menti inediti. Pistoia 1881. Cinus, geboren um 1270 in der oberitalienischen Stadt Pistoia, stammte aus dem vornehmen Geschlecht der Sinibul-di. Über seinen Studienaufenthalt ist wenig bekannt, im Jahre 1300 hörte er den durchreisenden französischen Juris-ten Petrus de Bellapertica (Pierre de Belleperche, gest. 1308, Rechtslehrer an der Universität Orléans). Seine Lehrer zu Bologna benennt Cinus: Franciscus Accursius, der Sohn des Schöpfers der Glossa magna, Dinus, und Lambertinus de Ramponibus. Seine Studien schloß Cinus um 1300 ab, eine Promotion hat er zunächst nicht abgelegt. Den Dok-torgrad erhielt er nach Abschluss seines großen Codexkommentars in Bologna 1314. Ein Studienaufenthalt an der Universität Orléans ist wahrscheinlich, nicht jedoch gesichert. Bereits im 13. Jahrhundert wurde dort ius civile gelehrt, im Jahre 1306 erhielt die Rechtsschule Universtätsstatus. Die Schule von Orléans übte im 14. Jahrhundert großen Einfluss auf die italienischen Koryphäen des Rechts, neben Cinus auch auf Bartolus de Saxoferrato und Baldus de Ubaldis (1327-1400). Das erste Jahrzehnt des 14. Jahrhunderts brachte für Cinus durch die heftigen Parteienkämpfe in der Toskana ein unruhiges, ja unstetes Leben. Teilweise soll er sich in den Bergen des Apennin versteckt haben. Noch 1307 war Cinus in Pistoia Assessor des dortigen Civilgerichts. Nächste gesicherte Nachricht ist ert 1310 erhalten, als Kaiser Heinrich VII. mit einem Heer nach Italien vorstieß. Ludwig von Savoyen zog in gleichen Jahr mit einem kaiserlichen Heer in Rom ein und Cinus wurde dort sein Assessor. Nunmehr nahm Cinus in seinen Schriften heftig Stellung gegen den Papst und vor allem gegen die Kanonisten, verteidigte die kaiserliche Position. Anschließend hielt er sich vermutlich in Neapel auf. Seinen großen Codexkommentar begann er Mitte des Jahres 1312 zu verfassen und vollendete ihn am 11. Juli 1314. Wo Cinus den Kommentar niederschrieb bleibt ungewiss, vermutlich in Pistoia; es kommt aber auch Neapel in Frage. Zweifelsohne ist er nicht in Bologna entstanden. Die Grundlage des Kommentars waren nicht von ihm gehaltene Vorlesungen, sonern er verfasste einen eigenständigen Kommentar. 5 Monate nach Vollendung des Opus maximum, Cinus war nunmehr 44 Jahre alt, erhielt er in Bologna die Doktor-würde. Danach widmete sich Cinus dem Lehramt an verschiedenen orten, ohne dass der Verlauf seiner Lehrtätigkeit lückenlos gesichert ist. 1318: für drei Jahre in Trevigi angestellt 1321-23: Lehrtätigkeit an der Universität Siena für 200 Fiorini d`Oro als Kollege von Andreas Pisanus und Federi-cus Petruccius. 1326: Annahme einer Professur in Perugia 1334: Wechsel an die Universität zu Florenz 1336: Rückkehr nach Pistoia ohne Annahme eines Amtes. Am 23. Dezember Errichtung eines Testaments, verstorben ein Tag später am 24. Dezember. 1337: Im Inventarium über seinen Nachlass ist als Todesdatum der 28. Januar 1337 vermerkt. Beerdigt wurde Cinus im Dom zu Pistoia in einem prächtigen Grab.
