Anhand von uber 3.000 ausgewerteten Fallen von Wehrmachtangehorigen und ZivilistInnen sind empirisch abgesicherte Aussagen uber militar…gerichtliche Strafverfahren, Verurteilungen, Delikte und Strafmasse moglich. Ein praktisches Ergebnis des Projekts ist eine Datenbank mit den Namen von ca. 1600 Personen, die Verfahren zur Rehabilitierung dieser weitgehend vergessenen Opfer ermoglicht. Die Delikte umfassten Desertion, Wehrdienstverweigerung, ,Wehrkraftzersetzung", Selbstverstummelung und Hochverrat, sowie bisher unbeachtete Tatbestande. Die Untersuchung zeigt, dass sowohl die Spruchpraxis der Gerichte als auch der militarische Strafvollzug grobes Unrecht waren, insbesondere bei den barbarischen Urteilen fur Bagatelldelikte. Die qualitative Auswertung von uber 30 Interviews mit Deserteuren und Wehrdienstverweigerern verdeutlicht ihre Verfolgung und die gesellschaftliche Behandlung. Wahrend der Deutsche Bundestag 2002 die kollektive Rehabilitierung von Opfern der NS-Militarjustiz beschloss, wird hier deutlich, dass in Osterreich eine gesetzliche Regelung zur Rehabilitierung uberfallig ist. Daruber hinaus ist diese Studie ein Standardwerk, da sie grundlegendes Material zur Struktur der NS-Militargerichtsbarkeit bietet, basierend auf der Sichtung mehrerer zehntausend Akten.
