Sein Ursprung liegt in dem Bestreben, die stark polarisierte Debatte über die Zulässigkeit sogenannter "humanitärer Interventionen", d.h. militärischer Einsätze zum Schutze der Zivilbevà lkerung eines fremden Staates ohne Zustimmung der betroffenen Regierung, auf eine neue Grundlage zu stellen. Die Formulierung einer Schutzverantwortung war der Versuch, die bestehenden rechtlichen und politischen Konflikte zu entschärfen und den erforderlichen Konsens für die effektive Verhinderung eines massenweisen Verlustes von Menschenleben sowie ethnischer Säuberungen zu schaffen. Aktuell erlangt die Thematik in der Diskussion über die NATO-Militäreinsätze gegen das libysche Regime sowie vor dem Hintergrund des sich zuspitzenden Konflikts in der Elfenbeinküste wieder besondere Bedeutung. "The Responsibility to Protect in International Law: Rights and Obligations to Save Humans from Mass Murder and Ethnic Cleansing in Light of State Practice and Ethical Considerations" zeichnet die Entstehung des Konzeptes der Schutzverantwortung sowie seine Entwicklung im Laufe der letzten zehn Jahre nach und erà rtert die Frage, inwiefern einzelne Komponenten inzwischen zu verbindlichem Và lkerrecht erstarkt sind. Im Einzelnen wird untersucht, ob Staaten, womà glich gar als Vorbedingung ihrer Souveränität, zum Schutze der eigenen Bevà lkerung verpflichtet sind, ob Drittstaaten mit oder sogar ohne UN-Mandat militärisch intervenieren dürfen, wenn die Regierung eines Staates ihrer primären Schutzverantwortung nicht nachkommt, ob sich aus dem Gedanken der R2P bereits eine Verpflichtung der internationalen Gemeinschaft zu einem solchen Einschreiten entwickelt hat, und ob das Và lkerrecht Kriterien für humanitäre Interventionen festlegt. Dabei werden, neben einzelnen Beispielen internationaler Reaktionen auf innerstaatliche Konflikte (insbesondere in Darfur), vor allem die Debatten der vergangenen Jahre in den relevanten UN-Organen berücksichtigt. Besonderes Merkmal der Untersuchung ist die Einbettung der materiellen rechtswissenschaftlichen Diskussion in einen umfassenden theoretischen und methodischen Teil, der Schwächen des herrschenden positivistischen Và lkerrechtsverständnisses aufzeigt und für eine subsidiäre Rolle ethischer Erwägungen plädiert. Auf dieser Grundlage wird eine ausführliche Diskussion einschlägiger ethischer Grundsätze vorgenommen, die sodann als Hintergundtheorie für die juristische Bewertung dienen. "The Responsibility to Protect in International Law: Rights and Obligations to Save Humans from Mass Murder and Ethnic Cleansing in Light of State Practice and Ethical Considerations" ist eine überarbeitetete Version der Masterarbeit, die der Verfasser im August 2008 zur Erlangung des LL.M.-Titels an der University of British Columbia (UBC) einreichte, und die 2009 mit dem LL.M Thesis Prize der Faculty of Law an der UBC für das akademische Jahr 2007/2008 ausgezeichnet wurde.
