Condition: as new. Oxford & New York : Oxford University Press, 2016. Hardcover. Dustjacket. 560 pp. English text. Condition : as new. - Recent years have seen an expansion in the scale and importance of economic, social, and cultural rights within international law. This has led to the adoption of the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights in December 2008, giving individuals and groups the ability to bring complaints about violations of these rights before the UN Committee on Economic, Social and Cultural Rights. In this context, this book assesses how effective efforts have been to realise international ESC rights, investigating the contemporary challenges obstructing their protection. It investigates the impact of the global financial crisis, the need for ESC rights to be implemented in a non-discriminatory manner, and the interrelationship between ESC rights and other international legal regimes. It provides a careful analysis of the new tools and indicators available to measure the progressive realisation of ESC rights. This book clarifies and illuminate the multiple aspects of the law governing ESC rights, by bringing together all the different aspects of ESC rights, re-stating the challenges they face, and assessing the progress that has been made in expanding their adoption. After an introduction by the editors on ESC rights and the contemporary issues in their realization, the book contains over twenty essays on the main issues related to the progressive realization of ESC rights and their monitoring mechanisms. The authors of the chapters, both scholars and practitioners, take an interdisciplinary approach to move beyond the traditional analysis of ESC rights, contextualizing their discussions against wider contemporary international law challenges. In reflecting this diversity of perspectives, the book sheds light on the new methodologies for implementation and the many obstacles faced by the realization of ESC rights. It is invaluable reading for scholars, students, practitioners, and NGOs working with or studying ESC rights. Condition : as new copy. ISBN 9780199685974. Keywords : RECHT, philosophy of law.…

Hardcover. Condition: new. Hardcover. This book addresses the international legal obligation to protect economic, social, and cultural human rights in times of armed conflict and other situations of armed violence. These rights provide guarantees to individuals of their fundamental rights to work, to an adequate standard of living (food, water, housing), to education, and to health. Armed violence can take many forms, from civil unrest or protest and other forms of internal disturbances and tensions tohigher levels of violence that may amount to armed conflict, whether of an international or of a non-international character. However, in all such cases the protection of ESC rights is sorelychallenged.Situations of actual or potential violence present a number of challenges to the application and implementation of human rights law in general and socio-economic rights obligations more specifically. This book sets out the legal framework, defining what constitutes a minimum universal standard of human rights protection applicable in all circumstances. It assesses the concept and content of ESC rights' obligations, and evaluates how far they can be legallyapplicable in various scenarios of armed violence. By looking at the specific human rights treaty provisions, it discusses how far ESC rights obligations can be affected by practical and legal challenges totheir implementation. The book addresses the key issues facing the protection of such rights in times of armed conflict: the legal conditions to limit ESC rights on security grounds, including the use of force; the extraterritorial applicability of international human rights treaties setting out ESC rights; the relationship between human rights law and international humanitarian law; and the obligations of non-state actors under human rights law and with particular relevance to the protectionof ESC rights. The book assesses the nature of these potential challenges to the protection of ESC rights, and offers solutions to reinforce their continued application. In times of armed conflict the protection of human rights often slips down the list of a state's priorities. This is particularly the case for those rights concerned with people's economic, social, and cultural needs. This book studies how those rights are impacted by armed conflict, which derogations apply, and how they can be better protected. Shipping may be from multiple locations in the US or from the UK, depending on stock availability. …

Hardcover. Condition: new. Hardcover. The United Nations Arms Trade Treaty became binding international law in late 2014, and although the text of the treaty is a relatively concise framework for assessing whether to authorize or deny proposed conventional weapons transfers by States Parties, there exists controversy as to the meaning of certain key provisions. Furthermore, the treaty requires a national regulatory body to authorize proposed transfers of conventional weapons covered by the treaty, butdoes not detail how such a body should be established and how it should effectively function. The Arms Trade Treaty: A Commentary explains in detail each of the treaty provisions, the parameters forprohibitions or the denial of transfers, international cooperation and assistance, and implementation obligations and mechanisms. As states ratify and implement the Treaty over the next few years, the commentary provides invaluable guidance to government officials, commentators, and scholars on the meaning of its contentious provisions. This volume describes in detail which weapons are covered by the treaty and explains the different forms of transfer that the Arms Trade Treaty regulates. Itcovers international human rights, trade, disarmament, humanitarian law, criminal law, and state-to-state use of force, as well as the application of the treaty to non-state actors. The Arms Trade Treaty is the first universal disarmament treaty to control the export and import of all conventional arms. This commentary describes each provision of the Treaty, how it was negotiated, and the key challenges to its implementation.
