Les commissaires-priseurs qui,… depuis un édit de Henri II datant de 1556, bénéficiaient avec les huissiers de justice et les notaires, d'un monopole en ce domaine, doivent céder la place à des sociétés de forme commerciale, du moins quand il s'agit de vente volontaires. Désormais, les grandes maisons anglo-saxonnes pourront, par l'intermédiaire de leurs filiales françaises, diriger des ventes en France. C'est cette réforme qu'expose notamment cet ouvrage. Une réglementation minutieuse, parfois tatillonne, car le législateur a tenu à encadrer la liberté nouvelle qu'il a instaurée en ce domaine par de multiples garde-fous indispensables à connaître. L'exposé traite aussi de l'ensemble des activités qui se déroulent dans le cadre du marché de l'art : vente en galerie, expertises, publication des catalogues raisonnés des uvres des peintres. Il passe donc en revue les différents professionnels qui achètent et vendent des biens culturels antiquaires, marchands de tableaux, experts, et précise les règles légales et jurisprudentielle applicables à chacun d'entre eux. Il aborde également le rôle des artistes et de leurs héritiers, dont l'intervention, fréquente sur le marché, vise à garantir ou à contester l'authenticité de certaines peintures. Une large place est consacrée à la jurisprudence de laquelle émerge, depuis quelques années, une ligne directrice constante : les juges s'efforcent de protéger de plus en plus efficacement les acheteurs et les vendeurs d' uvres d'art. En l'absence d'une loi particulière, ils font appel à des textes généraux auxquels ils donnent parfois une signification nouvelle. Aussi, une jurisprudence originale s'élabore-t-elle peu à peu en matière d'annulation de la vente pour erreur sur la substance ou de responsabilité civile des professionnels.
