Baillie had distributed a pamphlet criticizing the administration of the hospital, alleging that many of its officers had been appointed through political patronage… and that they were enriching themselves at the expense of the pensioners. Several of the officers he named sued Baillie for libel, and the case was heard before the Court of King's Bench in 1778. The trial was a significant event in the history of freedom of speech in England. Baillie's defense was led by the young lawyer Thomas Erskine, who argued that Baillie had a duty to speak out against the abuses he had witnessed and that the public had a right to know about them. The jury agreed, and Baillie was acquitted. The trial helped to establish the principle that the public interest in free speech outweighs the right of individuals to protect their reputations. It also showed that the courts were willing to hold powerful figures to account for their actions.
