Insbesondere im Falle der Auflà sung einer Ehe, einer Lebenspartnerschaft oder einer nichtehelichen Lebensgemeinschaft kommen zur Là sung dieser Probleme neben Normen des Familienrechts auch Normen aus dem Schuld-, Gesellschafts-, Steuer- und Arbeitsrecht in Betracht. Zusammen mit den durch richterliche Rechtsfortbildung gefundenen Regelungen bezeichnet man diese Gemengelage als Familienvermà gensrecht. Ein bekanntes Problem aus diesem Bereich bildet der auÃergüterrechtliche Vermà gensausgleich von Ehegatten in Form der Auseinandersetzung einer so genannten Ehegatteninnengesellschaft. Infolge einiger Entscheidungen des Bundesgerichtshofs aus den letzten Jahren ist nun aber ein neues Problem in den Fokus der familienrechtlichen Praxis gerückt: das Verbot der doppelten Teilhabe an Vermà genspositionen über Zugewinnausgleich und Unterhalt. Gegenstand dieser auch als Verbot der Doppelberücksichtigung bezeichneten Rechtsfigur ist die Vermeidung von einseitig benachteiligenden doppelten Vermà genszuweisungen im Rahmen des zwischen den Ehegatten nach einer Scheidung durchzuführenden Vermà gensausgleichs. Wie auch in anderen Fällen der Abgrenzung familienvermà gensrechtlicher Ausgleichsansprüche kà nnen dem Gesetz nur einige wenige Anhaltspunkte zur erforderlichen Abgrenzung von Zugewinnausgleichs- und Unterhaltsrecht entnommen werden. Es verwundert also nicht, dass sowohl die Abgrenzung von Zugewinnausgleichs- und Unterhaltsrecht als auch mà gliche Konstellationen, in denen das Verbot der Doppelberücksichtigung zur Anwendung kommen muss, umstritten sind. In Rechtsprechung und Literatur werden insbesondere die zugewinnausgleichs- und unterhaltsrechtliche Berücksichtigung von Unternehmen und Unternehmensbeteiligungen, arbeitsrechtlichen Abfindungen und Verbindlichkeiten diskutiert. Der Verfasser Franz Jakob Kà nig zeigt Gemeinsamkeiten und Unterschiede zwischen den in Rechtsprechung und Literatur vertretenen Ansichten und Là sungsansätzen auf. In diesem Zusammenhang geht er auch auf Probleme bei der zugewinnausgleichs- und unterhaltsrechtlichen Berücksichtigung einzelner Vermà genspositionen ein und dabei auf die umstrittene Bewertung von Unternehmen und Unternehmensbeteiligungen im Zugewinnausgleich.
