Paperback. Condition: New. Print on Demand. This book examines the fundamental ways in which rural Bavarian inheritance law has transformed over time and how it has affected the lives of farming families. Through an extensive analysis of legal codes and statutes that span centuries, the author explores how Bavarian inheritance law developed alongside the history of Bavarian land rights. Throughout the book, the author examines the concept of the "ältere weltliche Mannserbe," a legal principle that favored the inheritance of property by the eldest male heir, demonstrating how this principle evolved over time and revealing how it has shaped modern inheritance practices. Scholars of legal history and rural studies will find this book to be a valuable resource for understanding the evolution of Bavarian inheritance law and its enduring impact on the lives of rural Bavarians. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.…

Paperback. Condition: New. Print on Demand. This book challenges the long-held assumption that the German concept of an ancestral estate, where the primary heir assumes ownership of the primary property, aligns with longstanding German customs and legal tradition. The author traces the historical emergence of the tradition of ancestral property, not in a deep-rooted German national character, but in the nation's feudal past. The author reveals that it was not until the 17th century that the concept of ancestral property emerged, fueled by a desire to enhance the splendor of noble families. This concept did not impact the peasantry, who continued to practice an egalitarian form of inheritance for centuries. The author's deep dive into the legal framework of Bavarian inheritance law, as well as an extensive survey of inheritance practices within the farming population, provides compelling evidence against the widely accepted notion that an ancestral estate tradition has strong roots in German history and legal tradition. This book will appeal to anyone interested in the historical evolution of inheritance laws, the dynamic interplay between legal frameworks and established social practices, and the debunking of commonly held assumptions about German culture and law.
