Y en este aspecto, el tema ha llamado desde hace tiempo la atención de la doctrina jurídica italiana, y, antes que a ella y con mayor rigor científico, a la extranjera. Hay que reconocer que mientras la materia había encontrado una regulación expresa en otras legislaciones, en Italia, por el contrario, la ley guardaba silencio al respecto hasta la codificación de 1942; por consiguiente, si bien es verdad que la doctrina se había ocupado de tema tan difícil no lo es menos que, privada de una base legal positiva, hubo de intentar su construcción sobre el fundamento de los principios más dispares.Marcello Ruguglio.
