Den à ffentlichen Auftraggebern stehen dabei für die oberhalb der Schwellenwerte liegenden Aufträge traditionell das Offene Verfahren, Nichtoffene Verfahren und das Verhandlungsverfahren zur Verfügung. Durch Erlass der Vergabekoordinierungsrichtlinie 2004/18 hat der Gemeinschaftsgesetzgeber mit dem Wettbewerblichen Dialog eine weitere Mà glichkeit, à ffentliche Aufträge oberhalb der festgelegten Schwellenwerte zu vergeben, geschaffen. Der deutsche Gesetzgeber ist dem mit Erlass des ÃPP-Beschleunigungsgesetzes im Jahr 2005 gefolgt. Es handelt sich beim Wettbewerblichen Dialog um ein Verfahren, das für die Vergabe besonders komplexer Aufträge konzipiert ist. Im Gegensatz zu den anderen Verfahrensarten bietet der Wettbewerbliche Dialog den praktischen Vorteil, mit den Verfahrensbeteiligten Verhandlungen über den Auftragsgegenstand bereits vor Abgabe der Angebote führen zu kà nnen. Nach einer Einführung in das europäische und nationale Vergaberecht, die bereits das Vergabemodernisierungsgesetz und die Novellierungen der Vergabeverordnung sowie der Verdingungsordnungen beinhaltet, widmet sich der Verfasser eingehend dem Wettbewerblichen Dialog. Unter Berücksichtigung der Entstehungsgeschichte und dem Sinn und Zweck des Verfahrens untersucht der Verfasser den Anwendungsbereich des Wettbewerblichen Dialogs und den Verfahrensablauf. Besondere Beachtung finden in der Untersuchung die Abgrenzung des Wettbewerblichen Dialogs zum bereits etablierten Verhandlungsverfahren, die Auslegung und Konkretisierung des Merkmals "besonders komplexer Auftrag", der Schutz der eingereichten Là sungsvorschläge sowie die Frage, ob bei der Durchführung mehrerer Dialogrunden bereits ausgeschiedene Là sungsvorschläge in einer späteren Phase wieder ins Verfahren einbezogen werden dürfen. Im weiteren Verlauf der Studie geht der Verfasser auf das traditionelle Verhandlungsverfahren ein und stellt den Anwendungsbereich und Verfahrensablauf kurz dar, um es sodann dem Wettbewerblichen Dialog gegenüberzustellen und die jeweiligen Vor-/Nachteile herauszuarbeiten. Der Verfasser kommt schlieÃlich zum Ergebnis, dass der Wettbewerbliche Dialog aufgrund der frühzeitigen Einbindung der Unternehmen ein flexibles und notwendiges Verfahren darstellt, um besonders komplexe Aufträge vergeben zu kà nnen.
