Text is all-around gloss; printed in black and red. Dedicatory letter of H. Messaggius to Senator Federicus Baduarius (prelim. leafs [2]) is dated 1558. Period vellum, three raised bands; (leaves slightly offset, slightly browned; hinge cracked at rear, some quires loose, rear pastedown glue-stained). The Corpus Iuris Civilis or the Justinian Code, was the result of Emperor Justinian's desire that existing Roman law be collected into a simple and clear system of laws, or "code." Tribonian, a legal minister under Justinian, lead a group of scholars in an effort to codify existing Roman law. The result was the first Justinian Code, completed in 529. This code was later expanded to include Justinian's own laws, as well as two additional books on areas of the law. In 534, the Justinian Code, made up of the Code, the Digest, and the Institutes, was completed. Justinian's collections were, in ancient times, always copied separately, and afterwards they were printed in the same way. This part of the Institutiones falls under the whole Corpus Iuris Civilis, is an early example before the unification under this heading. The present name of Justinian's codification was only adopted in the 16th century, when it was printed in 1583 by Dionysius Gothofredus. The legal thought behind the Corpus Juris Civilis served as the backbone of the single largest law reform of the modern age, the Napoleonic Code, which marked the abolition of feudalism.

Very minor wormholes to some lower margins, little water stain to a few edges, a very good, clean, virtually uncut copy on thick paper, 16th century ms ex dono of Francisco Contareni of Santa Marina, Venice, at foot of first leaf, 19th century bookplates of Sir Edward Sullivan and William O'Brien on pastedown, Sunderland shelf mark on ffep. In a very handsome and typical 'Sunderland' binding c.1700 of red morocco, ornate outer border gilt of alternating fleur de lys and flowers, edges and inner border gilt to floral design, spine gilt in eight compartments decorated with leaves and tendrils, morocco labels, small case mark on paper at foot. Upper joint cracked, one corner worn, very grand in the English aristocratic taste. A very early edition (probably the 5th) of the single most important law book of the western world. The first edition was published by Schoeffer in Mainz in 1468 and is conspicuously rare. This and the present edition share the Glossa Ordinaria of Accursius. "No single authority has had greater influence in shaping the existing legal codes of all nations than the Roman Law; obvious in those which, like the Code Napoleon, sought to impose a theoretic standpoint, it may be felt even in fundamentally empiric bodies of law like the English Common Law. The credit for the survival of this authority can be ascribed in a very large degree to work undertaken by Justinian I, Roman Emperor of the East from 527 to 565." PMM p.3 Soon after his accession, Justinian ordered the codification of the entire chaotic body of existing law, which was completed in 533. "the Emperor directed Tribonian to prepare an introduction to the main work, and the elementary treatise thus produced, the 'Institutes of Justinian', has been for students ever since the introduction to the Roman law. When people speak of the Roman law today, what they mean is Justinian." PMM p.3 A very distinguished provenance. The ms ex dono (second quarter of C16th) records the gift of the volume by Francisco Contareni to the Church of St Peter Martyr in Venice. Contareni is a variant of 'Contarini', one of the greatest families of Venice, producer of senators, admirals, Patriarchs, and even Doges. Francisco describes himself as 'of Santa Marina', where the family had a palace, and an inscription is recorded of him in the Church of Santa Marina, now destroyed ,(Delle Inscrizioni Venezione I. p.339) which also received half his estate under his will; Francisco died in 1545. "The great library of Charles Spencer, Third Earl of Sunderland (1674-1722) contained only a few manuscripts and some 20,000 printed books; it was particularly strong in incunabula (many being printed on vellum)". Seymour de Ricci p.38. Sunderland purchased extensively through an agent, James Gibson, who travelled all over Italy, buying speculatively, especially from monastic collections, but always giving Sunderland first choice. The Sunderland Library, described in 1703 as the finest in Europe, was sold by the Duke of Marlborough in 1882 for over £56,500, a princely sum. Contents Fair to Very Good, no end pages, starts at Title page (looks 15th century), ends at last page that is dated for 5 December 1505. numerous old inscriptions to many pages, printed throughout in black & red ink with a couple of illustrations within text, with decorative initials/ chapter heads etc. clearly printed text, though title page has no spaces between most of the words of title. Some edge water staining to a few pages at front with edge loss, the cord holding text together is poor so text is spit into a few parts. A few edge nicks, one or two edge tears, some dirt to first/last page, some edge wear/dirt, no foxing, there is also one old sheet of paper with Latin notes on, that has been sewn in at the top of one printed page. Originally commissioned and altered/checked/revised on Roman Law by Emperor Justinian between 529-534 CE and known as Codex Justinianus, it was a complete revision of all Roman Law, much of which is still relevant and in use today. Justinian I, Emperor of the East, 483?-565. This work was first printed in France in 1470. So to sum up an early historically important printing of this title, dated to rear Mcccccv, v Decembus (Dec 5th 1505) in Fair condition, some poor, many in good & very good condition in need of rebinding, with lots of old Latin manuscript notes to many pages throughout, but with many pages good & very good without any notes. Vellum covers have been repaired and I believe the spine label was added at the time of repair. Copy with a tide line, quite occasional and brief worm holes, four pages with faded, brief marginal notations. While Worldcat lists this particular edition it finds no copies in any library. I found a copy listed at auction in 2005 but that copy with considerable repairs. This copy lists Sylvestro Albrandini as editor and this has a two column text with linear gloss. Title page and colophon both with Guntia device and dated 1560. Sharp copy with no repairs or underlining, except as noted, an 1890 ownership initial and date inside front cover, and four lines in Latin on ffep.

Im Westen bildete es die Grundlage einer Renaissance des röm. Rechts seit dem 11. Jahrhundert. Seine grundlegende Bedeutung reichte bis in das 19. Jahrhundert hinein.
