Gerät ein Institut aus Risikomanagementver-sagen in der Gesamtbanksteuerung in eine Schieflage, drohen dem Management Geldbußen und der Geschäftsleitung im Extremfall Haftstrafen. Die neue Finanzinformationenverordnung erhöht für die Bankenaufsicht die Transparenz in der Gesamtbanksteuerung bei den Erfolgsquellen und fordert die Meldung der GuV-Jahresplanung, um bei drohender Schieflage rechtzeitig eingreifen zu können. Die neue EBA-Richtlinie für Prüfung der Eignung von Schlüsselfunktionsinhabern und Mit-gliedern der Geschäftsleitung begründet neue Prüfpflichten für die Aufsicht und stellt dabei auf die Gesamtbanksteuerungskompetenz ab, die bei mangelnder Eignung Nachschulun-gen und im Extremfall personelle Konsequenzen nach sich ziehen.
