The immediate occasion was the disclosure of classified information about National Security Agency collection, which revealed the bulk gathering of telephony metadata under Section 215 of the Foreign Intelligence Surveillance Act and the targeting of non-United States persons under Section 702. Rather than auditing past practice in detail, the Group built a forward-looking framework around enduring principles, and its forty-six recommendations span surveillance law, organizational design, the security of digital communications, and the protection of classified information. The report's intellectual core is its rejection of the familiar metaphor of balancing liberty against security. Some safeguards, the authors insist, are not subject to balancing at all, because officials must never use surveillance to punish political enemies, suppress dissent, or burden groups by religion, ethnicity, race, or gender. In place of balancing they offer risk management, weighing risks to national security alongside risks to privacy, civil liberties, foreign relationships, and trade. Their most consequential proposal would end government storage of bulk telephony metadata in favor of private retention queried only when justified. Other recommendations impose prior judicial review on National Security Letters, extend the Privacy Act of 1974 to non-United States persons, make the NSA Director a Senate-confirmed post open to civilians, separate that office from US Cyber Command, reform the Foreign Intelligence Surveillance Court, and prohibit the government from undermining commercial encryption standards.
