Kick-backs schädigen sowohl das staatliche Vermögen als auch den Leistungswettbewerb. Die öffentliche Auftragsvergabe muss daher mit einer wirksamen Prävention durch das Vergaberecht und einer umfassenden Sanktionsandrohung durch das Strafrecht vor Kick-backs geschützt werden. Der Autor untersucht, inwieweit das Vergabe- und das Strafrecht dieser Aufgabe gerecht werden. Er analysiert das Vergaberecht nach Präventions- und Missbrauchspotenzialen sowie die Strafbarkeitsrisiken für an der Vergabe mitwirkende Bedienstete des Auftraggebers. Darauf aufbauend entwickelt er Vorschläge für eine intensivere Bekämpfung von Kick-backs, unter anderem einen Sonderstraftatbestand.
