Jueces y otros funcionarios, y abogados representando a otros ciudadanos, se ven a menudo envueltos en disputas sobre cómo resolver conforme a derecho diversos asuntos. Este fenómeno fue tomado por el filósofo estadounidense Ronald Dworkin como mater…ia prima para una de sus más conocidas y estudiadas críticas, la que tal vez sea la teoría general del derecho dominante en Occidente, el positivismo jurídico. Según Dworkin, las tesis y presupuestos conceptuales del positivismo nos impiden, fatalmente, explicar de manera adecuada el fenómeno del desacuerdo en el derecho. Si las disputas jurídicas son sobre cómo resolver correctamente casos particulares en los que se deben aplicar normas y otros estándares jurídicos, una comprensión del derecho factualista, de acuerdo con la cual este no es más que un conjunto de complejos hechos sociales (tal como parece sostener el positivismo), se mostrará ciega frente a ello y consecuentemente incapaz de iluminarnos acerca de las razones por las que dichas disputas se dan, los modos en que las partes en ellas involucradas actúan y, aún más, sobre el modo de resolverlas.
