Overall, this is a solid, tight, Very Good copy in like dust jacket, which appears to be price-clipped at the lower corner of the front flap, and has subtle sunning to the spine, bumps with creasing to the spine ends and corners, a tiny tear at the tail of the front hinge, mild rubbing and a touch of smudging to the covers, and a touch of ink transfer from the inscription to the head of the front flap. The jacket is wrapped in Mylar.

Er bezog in dem Methodenstreit der Weimarer Staatsrechtslehre Stellung gegen den positivistischen Neukantianismus. In dieser polemischer Schrift in 1921 kritisiert er der neukantianische Rechtsphilosophie grundlegend. Kaufmann war ein Verfechter des klassischen Naturrechts und ein Befürworter einer ontologischen und metaphysischen Betrachtungsweise des Rechts. Während der Zeit des Nationalsozialismus wurde Kaufmann wegen seiner Herkunft aus einer Familie jüdischen Glaubens als Jude verfolgt.
