What's next? Select Bibliography. Index. Non-Lethal Weapons offer viable options for addressing challenging scenarios in modern-day conflicts including peacekeeping operations, where the objective is to accomplish the mission and protect the force when lethal force is either unnecessary or even detrimental. Today, several states are actively engaged in countering terrorism, grey zone conflicts and armed conflicts resulting in high casualty rates for both sides. It would be valuable for the political and military leaders to consider the merits of Non-Lethal Weapons which are less likely to kill or to cause serious bodily injury than a conventional weapon, i.e., guns, missiles, bombs, yet help achieve the desired goal. Non-Lethal Weapons can include chemical and biological agents, electroshock devices, acoustic devices, optical munitions, blunt or rubber projectiles, traction modifiers, nets or rapid-hardening rigid foam, microwave technologies, noxious smells, and acoustical interference technologies. The book looks at CALM (concepts, application, legal and moral) issues of use of non-lethal weapons in the current context. Besides the history, concept and design of various modern non-lethal weapons, it covers application for military and United Nations Peacekeeping operations in detail. The ongoing debate about legal and moral aspects of the use of force, in general, and non-lethal weapons, in particular, brings in a 360 perspective on the issue of non-lethal weapons before moving forward to exploring the field of neuro weapons and their implications.…

Hardcover. Condition: New. The People's Liberation Army (PLA) a unified organization of China's land, sea, and air forces, owes allegiance to the Communist Party of China (CPC). It consists of nearly two million active-duty officers and civil cadres, NCOs, and conscripts. These personnel are governed by a large number of laws, rules and regulations. There is a lack of transparency and openness not only in the Chinese military court system but also in the personnel system. The PLA is undergoing a major transformation in the organisation, equipment and legal frameworks specifically after Xi Jinping took over the reins. PLA being a subset of Chinese society will reflect the changing values of society and replicate that in its own culture. This is where laws, rules and regulations controlling the society in general and PLA, in particular, will play a major role. This book looks at various facets of Chinese military laws, their implementation process and the subsequent impact on its military.…

Today, with thousands of nuclear weapons deployed by multiple states including not so stable regimes and a possible access to non-state actors, threat of a nuclear conflagration persists. An accident or a rash decision could trigger an unprecedented man-made crisis. Even testing and storage of nuclear weapons has attendant environmental and human costs. And states continue to spend unprecedented amounts on upkeep and modernisation of nuclear weapons and their delivery platforms on land, air and maritime domain. International treaties and legal frameworks to contain and eliminate nuclear weapons are rather weak and discriminatory. In spite of some regional initiatives for creation of Nuclear Weapon Free Zones or No First Use policies by nuclear weapon owners, humanity continues to live under the dark shadow of a nuclear threat. Is our society looking at the issue in a holistic fashion to find a solution or trying to defer the hard decisions to the next generation? To understand the issue, this book looks at nuclear weapon's impact of various facets of our society including human and environmental costs and further examines the issue of various procedures, processes and legality in this domain.…

The access to space and its use cannot be put in reverse gear. Outer space is still a peaceful place but the possibility of this domain turning into a theatre of armed conflict cannot be ruled out. Will battlespace engulf outer space? It is imperative to define how the military can use space assets, protect them, and devise new ways of handling this unique environment. Certain questions relating to the exploitation of outer space demand clear answers. For instance: Is outer space a part of battlespace? What is the international responsibility for the actions of commercial establishments and non-state actors in outer space; What military activity could be permitted on the Moon and celestial bodies; Where are the thresholds for interference, intervention, use of force, and armed attack in self-defence lies; and, Whether IHL applies in the event of an armed conflict occurring in the outer space? This book attempts to search for answers to some of these issues.…

Soft cover. Condition: New. The Army Act (1950), the Air Force Act (1950) and the Navy Act (1957) provide a different legal framework for governing three wings of the Indian Armed Forces. These laws are derived primarily from the military laws promulgated by the British to govern the Native Indian Army and specifically after the Great Rebellion in 1857, its provisions were made more severe to serve the purposes of colonial masters. Even 75 years after Independence, several legal provisions followed in the Indian Armed Forces have a colonial footprint. The civilian criminal justice system in India, which has been modernized on the progressive principles of human rights, has been unjustly kept away from the military domain. The wind of change blowing over the military law world over has not permeated the closed prescient of the Indian military justice system. Since 2014, the government has repealed more than 1,500 old and obsolete laws; most of these were remnants of the British Era. However, the military legal system of the Victorian era is yet to see any change. With changing character of war forcing modernization of the three wings including a planned integration, there is a need to have a modern common law for the Indian Armed Forces. It must be based on our constitutional guarantees, changing composition of the armed forces, progressive principles of justice and human rights norms. This book takes a 360 view of the evolution of the Indian Military Legal system and proposes a pragmatic path ahead. Besides the armed forces and paramilitary personnel, this book will be of interest to parliamentarians, jurists, bureaucrats, and members of civil society who are associated with justice and accountability.…
