Anteriormente José Bonaparte, hermano de Napoleón Bonaparte elaboró un texto constitucional para España, la Carta Otorgada de Bayona de 1808…que nunca entró en vigor. Desde esa fecha hasta la actualidad conocemos una larga secuencia de constituciones que no pudieron mantenerse en el tiempo, debido a las discrepancias de sus realizadores. Así, la secuencia ordenada de constituciones españolas da el siguiente resultado: 1812, Constitución progresista (de cinco a seis años de vigencia en años alternos); 1834, Estatuto Real conservador (tres años de vigencia); 1837, Constitución progresista (ocho años de vigencia); 1845, Constitución conservadora (veinticuatro años de vigencia); 1869, Constitución progresista, (cuatro años de vigencia); 1876, Constitución progresista, (cuarenta y siete años de vigencia); 1931, Constitución progresista, (ocho años de vigencia); 1938-1975, Leyes franquistas (treinta y siete años de vigencia); 1978, Constitución progresista, (vigente hasta la actualidad). La constitución vigente tiene, en comparación con las demás constituciones, la ventaja de haberse elaborado en un clima de consenso, inédito en la historia de España. Esa colaboración entre partidos políticos, de muy diversa y, a veces, confrontada ideología, hizo posible la elaboración de un texto que sumaba adeptos y conseguía unificar criterios, pues su interpretación lograba dar solución a una inmensa multitud de problemas. El respeto a sus principios ha posibilitado que cualquier actividad política pueda medirse por su carácter de constitucionalidad o de inconstitucionalidad. Así mismo, la existencia de un Tribunal constitucional garantiza la solvencia de las leyes y el respeto de las autoridades para con la ciudadanía.
