Condition: Very Good. The plaintiff, a British subject, was in 1815 a merchant in Florida, then belonging to Spain, and was the owner of about 100 negro slaves. The defendant, Sir A. Cochrane, was the commander in chief of his Majesty's fleet on the North American station, and Sir G. Cochrane was the second in command. On the 24th February 1815, 38 of the plaintiff's slaves, escaping from his plantation, went on board one of his Majesty's vessels lying not in Spanish waters. The plaintiff asked the defendant G. to deliver up the slaves. G.C. told him that he might see them, and endeavour to persuade them to return. They refused, and the defendant G.C. to convey the slaves to the British colony of Bermuda, whither they were taken. Action of trover. The King of the Two Sicilies filed a bill in Chancery, alleging that during a rebellion in Sicily the revolutionary government seized upon his treasure, and remitted part of it to agents in this country for the purchase of steamships; that a steamship was purchased accordingly from the Peninsular and Oriental Steam Packet Company, and registered in the names of British subjects who were alleged to be trustees for the agents of the revolutionary government. Condition: Very Good. On January 20, 1843, McNaughton fired at and wounded Mr. Drummond, Sir Robert Peel's private secretary. Mr. Drummond having died, McNaughton was indicted for murder. At the trial medical witnesses were called to prove the prisoner's insanity; and Tindal, C.J., finding that the Crown was not prepared with medical evidence to contradict them, stopped the case, and the jury, under his direction, found the prisoner Not guilty on the ground of insanity. Daniel McNaughton (Daniel McNaghten, sometimes spelled Macnaughton, McNaughtan or McNaughton, 1813-1865), a wood turner and carpenter from Glasgow became involved in radical politics, including Chartism, and developed a belief that he was being spied upon by the authorities. This article is chiefly concerned with his trial and acquittal on the grounds of insanity. The result of his trial in 1843 gave his name to the legal test of criminal insanity in England known as the McNaughton Rules. There is some controversy surrounding McNaughton in regard to money found upon him when arrested, how it was come by, and whether he was part of a larger conspiracy to murder Peel. His trial took place at the same time as those of the Lancaster Chartists and as such can be rather overlooked.
