Detlef Heintz Die zulässige Anordnung und Lage von Gebäuden auf einem Grundstück wird durch das Bauplanungsrecht und durch die Vorschriften der Landesbauordnungen über Abstandsflächen beeinflusst. Da das komplizierte Abstandsflächenrecht zu einer ausufernden Rechtsprechung führte, hat die Bauministerkonferenz die Mustervorschrift wesentlich gestrafft und vereinfacht. Nachdem mehrere Bundesländer diese Vereinfachung bereits in ihr Landesrecht umgesetzt haben, liegt hiermit auch für Nordrhein-Westfalen die Änderung der Abstandsflächenvorschriften der Landesbauordnung vor.
