Non è facile. Medio evo si dice è soltanto un concetto della nostra mente, qualcosa dunque di relativo, e destinato a sparire quando le ragioni che lo generarono si saranno consumate nella nostra coscienza. E diritto si dice anche è una cosa che i giuristi cercano ancora di definire. Queste, le basi dell'astrattezza del titolo, se pur è da ammettere che un'astrattezza abbia basi. Tuttavia, se vogliamo esser sinceri, confessiamo pure che quelle astrattezze sono state per secoli gli spiragli attraverso i quali lo spirito umano è riuscito a intravedere qualcosa di concreto: altrimenti, non avremmo potuto nemmeno pensare quelle astrattezze. E a questi spiragli vorremmo che altri occhi si accostassero ancora e ficcasser lo viso: ma, perché essi non temano di veder delle nebbie, noi vogliamo dir subito, adoprando parole tutte dell'uso comune, che codesto qualcosa di concreto è semplicemente una «storia del diritto», che ha come sua epoca il «medio evo», come teatro d'azione l'«Italia». Ma qui ci nasce l'obbligo di dar conto di ciascuna di queste affermazioni, e proprio per paura dell'uso comune che le ha consacrate, e spesso fraintese. Le ha fraintese in modo particolarmente grave di fronte al primo e fondamentale problema che quella storia pone, e cioè quello delle fonti del diritto. Da questo, perciò, sentiamo il bisogno di rifarci.
