Synopsis

To the work The large "Internet Law of the EU", the Digital Services Act (Digital Services Act), was published on October 27, 2022. The new, very far-reaching EU regulation on business transactions on the Internet contains regulations on the responsibility of intermediation platforms as well as other platform requirements, e.g. provisions on contact persons, transparency regulations, provisions on the indirect influence of general terms and conditions by fundamental rights, reporting obligations, complaints and reporting systems as well as dispute resolution systems. In addition, a new government structure ("Digital Service Coordination") is created. The new EU regulation targets platform operators, search engines and social networks that currently have at least 45 million active monthly users in the EU. While the parallel adopted "Digital Markets Act" is intended to limit the market power of Internet giants such as Facebook, Amazon and Google, the DSA deals with the regulation of the content shared by these intermediaries, according to the will of the Commission. What is prohibited offline should also be prohibited online. This involves illegal hates and counterfeit products. In addition, the DSA also includes detailed provisions on when platform operators, social media and other intermediaries can invoke liability privileges, i.e. when they are not responsible for the content you share. In order to improve consumer protection and protect fundamental rights, a new era of transparency and public control of the major platforms is also established. Regulators and supervisory bodies acting in the public interest receive legal means to investigate systemic risks of online platforms. Online advertising and so-called "Dark Patterns" are further limited. Excesses of platforms such as tracking-based ads or misleading designs are regulated more stringently. Detailed rules can also be found on how to handle moderation decisions on platform content. In addition, the DSA creates comprehensive possibilities for efficient sanctions. The new work is designed as a hand commentary for practice with scientific claims. The renowned authors explain the complex regulations scientifically based with practicable and manageable solutions.
