Today, the European Union (EU) and the Organisation pour l'harmonisation en Afrique… du droit des affaires (OHADA) are the two most integrated supranational organisations in the world. On the one hand, OHADA was institutionally modelled on the EU. But on the other hand, based on an essentially French legal tradition, OHADA was able to go much further in the unification of commercial law, as evidenced by meanwhile eleven Uniform Acts relating to principally all aspects of commercial law. 140 years after the beginning of the so-called Berlin Conference concerning the Scramble for Africa this comparative approach also reflects the paradigm shift in the relationship between Europe and Africa.; Der vorliegende Band enthält alle Beiträge, die während der Arbeitssitzung der Sektion für vergleichendes Handels- und Wirtschaftsrecht auf der 39. Tagung der Deutschen Gesellschaft für Rechtsvergleichung in Berlin präsentiert wurden. Heute sind die Europäische Union (EU) und die Organisation pour l'harmonisation en Afrique du droit des affaires (OHADA) die beiden am stärksten integrierten supranationalen Organisationen der Welt. Einerseits wurde die OHADA institutionell nach dem Vorbild der EU modelliert. Andererseits konnte OHADA, ausgehend von einer im Wesentlichen französisch geprägten Rechtstradition, bei der Vereinheitlichung des Handelsrechts deutlich weiter voranschreiten, wie inzwischen elf einheitliche Rechtsakte belegen, die sich auf nahezu alle Aspekte ds Handelsrechts beziehen. 140 Jahre nach Beginn der sogenannten Berliner Konferenz über den 'Wettlauf um Afrika' spiegelt dieser rechtsvergleichende Ansatz zugleich den Paradigmenwechsel in den Beziehungen zwischen Europa und Afrika wider.
