Diese ungeschriebenen Fre…iheiten wurden - ohne Anknüpfung an den Verfassungstext - unter Herausbildung verschiedener Kriterien 'frei' entwickelt. Auch das Bundesverfassungsgericht hat Wege gefunden, individuelle Rechtspositionen zu stärken. Methodisch geschieht dies hier allerdings immer durch die Anknüpfung an benannte Garantien. Trotz der formalen Anlehnung an ausdrücklich geregelte Freiheiten entwickelte das Bundesverfassungsgericht dabei allerdings quasi eigene Tatbestände und verselbständigte, konsistente Rechtspositionen, so dass man auch hier von ungeschriebenen Freiheitsrechten sprechen kann. Zentrale Bedeutung kommt bei dieser Rechtsprechung Art. 2 Abs. 1 GG in seiner Auslegung als allgemeine Handlungsfreiheit zu. Im Mittelpunkt steht dabei das Spannungsverhältnis des erklärten Sterbenswunsches des Patienten und der strafrechtlichen Sanktion solcher Sterbehilfe nach dem StGB. In dieser Arbeit soll beleuchtet werden, ob und unter welchen Voraussetzungen ein Behandlungsabbruch, als Form passiver Sterbehilfe, bei Patienten zulässig ist, die am apallischem Syndrom leiden ('Wachkomapatienten'). Solche Patienten können oft jahrelang im Wachkoma liegen und sind vollständig von der medizinischen Betreuung und Apparatur abhängig. Sie haben zum Zeitpunkt der Entscheidung keine Möglichkeit mehr, sich selbst zu dieser Frage zu äußern. Daher wird ebenfalls untersucht, wie das Selbstbestimmungsrecht des Patienten in diesen Fällen durch Patientenverfügungen und Vorsorgevollmachten gesichert werden kann.
