No hay una respuesta unívoca a cuál sea la naturaleza jurídica de la objeción de conciencia, pero la posición de la que se parte en estas páginas, de acuerdo con la jurisprudencia constitucional mayoritaria, es la de que el derecho fundamental a la libertad de conciencia no habilita directamente al incumplimiento de las leyes, pues ello supondría la relativización de los mandatos jurídicos y, como afirmase el Tribunal Constitucional, pondría en entredicho la propia idea de Estado. El asunto se afronta en estas páginas desde distintos ámbitos, como el del CEDH (valorándose el alcance de la disidencia ideológicamente motivada al amparo de la libertad de pensamiento, conciencia y religión del artículo 9 CEDH, según ha sido interpretado por el TEDH); o el de la Carta de Derechos de la Unión Europea (evaluándose la protección que el artículo 10. 2 de la Carta otorga a la objeción de conciencia). Se abordan también conflictos de conciencia determinados, como el que se genera en el ámbito educativo (frente al servicio público de enseñanza), en el de la interrupción voluntaria del embarazo; o el que puede surgir a un farmacéutico o a un juez en el ejercicio de sus funciones.
