The proposed H.R. 146 was to delineate new procedures addressing misconduct of judges. Article III states that these judges "hold their office during good behavior," which means they have a lifetime appointment, except under very limited circumstances. Article III judges can be removed from office only through impeachment by the House of Representatives and conviction by the Senate. H.R. 146 would make available, in cases involving circuit or district judges, an alternative procedure by trial of and judgment upon the issue of good behavior before the special statutory court for which the bill provides. This bill would keep the House of Representatives as a buffer between the judge and the necessity for him to go to his defense in a civil action suit initiated by the Department of Justice, and would also provide a normal, workable method of getting rid of crooked judges, and would be a step in the direction of giving the judiciary greater control over judges. Hatton William Sumners (May 30, 1875 April 19, 1962) was a Democratic Congressman from the Dallas, Texas area, serving from 1913 to 1947. He rose to become Chairman of the powerful House Judiciary Committee. As a loyal Democrat, he supported much of President Franklin Roosevelt's New Deal legislation. He drew the line at Roosevelt's plan to expand the US Supreme Court, after the Court began to rule that key parts of the New Deal were unconstitutional. As Chairman of the Judiciary Committee, Sumners discreetly worked in opposition, and came out formally against the Court-packing plan.

Wraps. Condition: as is. Presumed First Edition, First printing. 14, [2] pages. This is a thoroughly disreputable copy, but it may be the only separately printed copy existing of this speech. The text appears complete although the title page through page 4 is missing pieces, but no text lost, and a number of pages are stained and somewhat discolored. Edges and torn and chipped. The back cover has a smaller portion missing than does the front. This speech was, apparently, first printed in the Congressional Record. This version notes applause and also includes at the end some material about a reprinting of a letter from A. W. Neale with this speech. Mr. Neale was a former Confederate soldier who served in A. P. Hill's Corps. He complimented the Congressman on the speech and recounted his story of the trip to Appomattox. Also included are excerpts of Grant's 1867 testimony before the House Judiciary Committee. Congressman Sumner was the son of a Confederate soldier. No copies of this publication were identified through a WorldCat related search. Hatton William Sumners (May 30, 1875 - April 19, 1962) was a Democratic Congressman from the Dallas, Texas area, serving from 1913 to 1947. He rose to become Chairman of the powerful House Judiciary Committee. Sumners ran for and was elected in 1912 to an at-large seat as a Democrat to the Sixty-third Congress, taking office on March 4, 1913. He was the first of the 132 freshmen congressmen in that Congress to get a bill through the House; the bill made Dallas a port of entry for US Customs. In 1914, he ran for the seat from Texas's 5th congressional district, which included Dallas, Ellis, Rockwall, Hill, and Bosque counties, and he was elected. Sumners served on the powerful Judiciary Committee of the House of Representatives and was appointed regularly to investigate allegations of corruption among federal judges. He served on the impeachment committees for three federal judges: George W. English, Harold Louderback, and Halsted L. Ritter. In 1924, Sumners became acquainted with Supreme Court Chief Justice William H. Taft and worked with him to pass a bill amending the judicial code, also known as the "Judges Bill.".
