Studying law yields fresh insights into the meaning of colonialism to those who were empowered by it and those who struggle against it. Law in Colonial Africa was a cultural project, which lay at the heart of efforts by Europeans and Africans to channel social change. The contributors in this volume use different approaches and employ different sources to investigate the interaction between law and social history. This book simultaneously casts new light on the colonial experience of Africans and Europeans, assesses the research potential of untried sources and methods, and charts the intellectual agenda for further historical and anthropological studies of law. The scholars represented in Law in Colonial Africa understand law as a dynamic historical formation which at once shapes and is shaped by economic, political, and social processes. Drawing on recent research of anthropology, history, and critical legal studies, they conceive of law not as an impartial arbiter guided by fixed rules and procedures, but as a human construct invoked by some at the expense of others in struggles over resources, power, and authority. Studying law in colonial Africa illuminates who won and who lost in struggles over resources and over authority, and how and why. It also uncovers the terms of the debates over what custom was or should be.
