Softcover. Condition: Fair.

Softcover. Condition: Fine. Gebogener Buchrücken; Geknickte Ecken. Academic research on the protection of national minorities often focuses on the legal frameworks of individual countries. However, the real challenge lies in the implementation of these laws by administrative authorities and courts. Drawing on two years of legal and empirical research, this work examines the discrepancies between the written law and its practical application regarding minority protection in six Central and Southeast European countries: Austria, Hungary, Italy, Romania, the Slovak Republic, and Slovenia. The first part offers a comparative analysis of the legal landscape across six critical areas essential for effective minority protection: culture, language use, media, education, economic participation, and political participation. The second part presents empirical findings from extensive field research in these countries, highlighting the interconnectedness of these areas. The analyses demonstrate that a comprehensive policy for minority protection must consider these interdependencies. Additionally, the book provides a set of recommendations valuable for practitioners in international organizations, NGOs, national authorities, and representatives of national minorities, enhancing their efforts in promoting effective minority rights and protections.

Hardcover. Condition: new. Hardcover. Hardcover. Condition: new. Hardcover. The Covid-19 pandemic has revealed how far we as a European society still are from the proclaimed Union of Equality. The book explores how the promise of equal treatment can become a reality and compliance with the EU acquis relating to equality and non-discrimination can be improved. It studies enforcement and promotion aspects of the two watershed directives of 2000, the Racial Equality Directive 2000/43/EC and the Employment Equality Directive 2000/78/EC, throughthe lens of reflexive governance. This governance approach is proposed as having great potential in enhancing the likelihood of sustainability (or continuation) of reforms in the current candidatecountries and EU Member States through its emphasis on reflexive learning processes and the cooperation between EU institutions, national authorities, and civil society actors. In order to deploy this potential, there is, however, a need for more consistent and transparent monitoring, both with regard to candidate countries as well as old and new Member States, and a reconsideration of the understanding of monitoring as such. It should be seen as helping to deconstruct ownpreference-formations and as a possibility to learn from successes and failures in a cooperative and recursive process. To work on these lacunae and improve learning and monitoring processes, thisbook identifies indicators, that are deduced from the comparative review of the implementation practice of the member states. This book is thus a contribution to the existing literature in the fields of Europeanization, governance, and the right to equality and non-discrimination. This title explores the reality of equality and non-discrimination within the EU. It includes case studies from the two main directives in relation to equality laws and shows how they have been implemented. This book also identifies indicators that facilitate compliance monitoring among Member States and candidate countries.
