Deze monografie bevat veel praktische informatie en is geschreven voor een breed publiek: zij die in het bestuursrecht werkzaam zijn, bestuursrecht studeren of anderszins daarin geïnteresseerd zijn. Wat is het belang van de voorlopige voorziening in het bestuursrecht? Het maken van bezwaar of het instellen van beroep brengt in het algemeen niet met zich dat de werking van het bestreden besluit wordt opgeschort in afwachting van de uitkomst in die procedures. De verkrijger van een vergunning kan, ook als een derde daartegen bezwaar maakt, toch direct aan de slag. Bij een besluit tot terugvordering van een uitkering kan het bestuursorgaan, ondanks het bezwaarschrift van betrokkene, gaan terugvorderen. Het ontbreken van opschortende werking kan tot nadelige gevolgen leiden. Zo kan vorenstaande vergunninghouder de hem vergunde activiteiten voltooid hebben als de bestuursrechter tot het oordeel komt dat die vergunning ten onrechte is verstrekt. Blijkt achteraf de bovengenoemde terugvordering van de uitkering onrechtmatig, dan kan betrokkene inmiddels in flinke financiële problemen zitten. Met het aanwenden van rechtsmiddelen is hij dan niet zo veel opgeschoten. In dit soort gevallen kan de procedure van de voorlopige voorziening uitkomst bieden. Hangende bezwaar of beroep kan betrokkene namelijk de voorzieningenrechter bestuursrecht verzoeken ter voorkoming van nadeel een voorlopige voorziening te treffen voor de duur van de procedure. Honoreert de voorzieningenrechter dat verzoek, dan luidt zijn uitspraak voorlopige voorziening in de genoemde voorbeelden dat hij de vergunning of het besluit tot terugvordering van de uitkering schorst totdat in de bodemprocedure is beslist. Bij die schorsing gaat het om een voorlopige maatregel hangende de bodemprocedure en om het voorlopig oordeel (een inschatting) van de voorzieningenrechter over de uitkomst in die bodemprocedure.
