Los cuales se encuentran regulados en el artículo 139. Del citado cuerpo constitucional en el Capitulo VIII del Poder Judicial. Y a la vez se ven reflejados en la Ley Orgánica del Poder Judicial en la sección Primera acerca de los principios Generales, cabe señalar que se tomara en cuenta la jurisprudencia emanada por el Tribunal Constitucional del Perú debido que dicho órgano es el máximo intérprete de la Constitución y por ende ligado íntimamente al presente trabajo.
