Printed slip from nineteenth-centrury catalogue describing the item laid down on first leaf. Doane begins 'My dear Sir, | Through the medium of M. George (whom I have had the pleasure of seeing since I wrote you last) I send de la part de M. Bentham the following works'. A list of thirteen items follows, from 'Christomathia 2 vols' to 'European Magazine for April 1823'. 'Those which are marked thus * Mr. B. wd. be obliged to you if you wd. transmit them to M. Felix Bodin [(1795-1837), French historian and politician]. According to Doane, the issue of the 'European Magazine' contains 'the best information respecting the life of Bentham, as it was obtained thro' my means: owing to circumstances it never was continued.' Doane ends by describing the circumstances in which Bentham befriended the Earl of Shelburne (later Marquess of Lansdowne): 'It was at Bowood that Bentham first became acquainted with M. E. Dumont, which led subsequently to the appearance of the most admired works of Bentham in french'. For biographical details of Doane see A. A. Doane, 'The Doane Family' (1902). Bentham bequeathed to his 'dear friend and quondam amanuensis and pupil, Richard Doane, barrister-at-law, all his books on English law, and also his organ'. A landmark in the field of legal philosophy. "Bentham was one of the first scholars in English legal history to analyze the rules of evidence by reference to philosophy and logic. He called English evidence law the technical fee-gathering system whose obscure rules and formalities were repugnant to the ends of justice. Evidence rules existed almost exclusively at common law, yet judges were not accountable for the decisions they rendered. Bentham argued that judges and lawyers used their stations to produce expense and delay in legal proceedings in order to make better business for themselves. The augmentation of profit constituted the goal of the technical fee-gathering system, while diminution and resolution of crime was only a collateral concern. For Bentham, this system was problematic because it was set up to further the financial and personal interests of a small professional class, rather than to further the interests of society as a whole." The indirect end of procedure is avoidance of preponderant vexation, expense and delay also judged by utility. Bentham takes hammer and tongs to the Anglican Catechism, embodied in the Book of Common Prayer, calling it a bad substitute for the Bible itself, and demanding the abolition of its use in schools. To those who wished to compromise by supplementing it with new material, he had the following clear answer: "expound an exposition?No: absurdity is involved in the very idea of it. The longer a text, the greater the quantity of matter, for commentators and expositors to crawl over with their slime.".
