Attractive smyth sewn tan cloth with green gilt stamped labels on the spine and front cover. New. $75. * Anthony Stokes (1736-1799) served as the Chief Justice of the colony of Georgia from 1769 until the outbreak of hostilities in 1776. A devoted Loyalist, Stokes was imprisoned by American forces and eventually expelled from the continent. Following the British recapture of Savannah, he returned to his post in "restored Royal Georgia" from 1779 to 1782, giving him a singular, firsthand perspective on the collapse and brief resurrection of British legal authority in the American South. Writing in the immediate aftermath of the war, Stokes provides a vital contemporary assessment of British colonial jurisprudence. Legal historian Paul S. Reinsch notes that the work provides "a very interesting discussion of the state of legal administration in the southern colonies. Stokes also discusses what part of the English Common Law the colonists had brought along with them." Of particular historical importance are Stokes' detailed chapters detailing the operations of the Colonial civil and criminal courts, the roles of counsel and attorneys, and the structures of the Courts of Vice-Admiralty. Crucially, the work serves as a foundational text for the legal history of the transatlantic slave trade and southern plantation law, featuring extensive examinations of the regulations governing enslaved populations, modes of property conveyance, and the legal mechanics of manumission.
