The practical guide for the people who actually run the tribunal.
"A very complete book … very useful for anyone who is newly appointed to work in a tribunal … very clear and at the same time very accurate." — Dr. Felix Menendez, JCD, STL
Working in a Catholic marriage tribunal is a unique ministry, one that demands both legal precision and genuine pastoral sensitivity. Tribunal officers are entrusted with the stories of people navigating the painful aftermath of a failed marriage, while at the same time being called to investigate those stories objectively and seek the truth about the marital bond.
Understanding the Catholic Marriage Tribunal is written for the officers who carry out that work day to day — case managers, ecclesiastical notaries, auditors, and support personnel — especially those who must learn the work without holding a licentiate in canon law. Rather than serving as a technical canon law treatise, this book clearly explains how marriage nullity cases are actually handled in first-instance North American tribunals.
What you'll find inside:
- Formal nullity cases followed from the libellus through citation, the joining of the issue, the gathering of proofs, publication of the acts, and the definitive sentence
- Documentary cases and the briefer process before the bishop (processus brevior), with the conditions each requires
- Special dissolution procedures, including cases that fall outside the ordinary nullity process
- The roles explained plainly: judge, defender of the bond, auditor, notary, procurator and advocate, and where each one's responsibility begins and ends
- Grounds for nullity and how the doubt is formulated in practice
- What happens after the sentence: appeal, confirmation, and prohibitions attached to a party
- A full appendix of sample decrees, letters, and notifications, drawn from a single worked case you can follow from first contact to confirmation
- Complete party and witness questionnaires in English, Spanish, and French: Both the party examination questionnaire and the witness questionnaire are ready to adapt for your own tribunal. If you have ever tried to interview a party in a language your office does not have forms for, you already know what that is worth.
Drawing on years of experience in tribunals in North America, Louis Meléndez González offers the vocabulary, procedures, and confidence tribunal officers need to do their work well — always returning to what matters most: the people behind the case.
