Print on Demand. This book delves into the intricate world of public ways, offering a comprehensive exploration of the legal principles governing highways, turnpike roads, and public bridges. Examining a wide range of historical precedents, the author seeks to clarify the distinction between public and private ways, exploring the origins of public rights of way and the legal framework for their maintenance. The book scrutinizes the crucial concept of 'thoroughfare' and its application in determining the status of public ways, highlighting the potential pitfalls of defining highways without a clear thoroughfare. The author critiques previous legal opinions, specifically focusing on the landmark case of *The Rugby Charity v. Merryweather,* where the court declared that a street without a thoroughfare could still be considered a public way. The book systematically presents counterarguments to this decision, drawing upon legal principles and historical precedent to underscore the significance of thoroughfare as a defining feature of a public way. The author further explores the impact of the *Rugby Charity* case on the legal landscape, particularly in relation to the apportionment of public funds for the maintenance of roads and the protection of private property rights. The book's insights into the legal complexities of public ways offer a valuable resource for legal professionals, historians, and anyone seeking a deeper understanding of the legal and societal foundations of public thoroughfares. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book.…

IT is believed, that this is the first attempt, which has been made, to bring under one view the whole of the law respecting public ways, and to reduce into one continuous system its various principles. And perhaps a more favorable period for such an effort could not be assigned. Many decisions have lately been pronounced by the Courts upon this subject; and though there are several dicta which it is difficult to reconcile with other authorities or with principle, yet in scarcely a single instance have they received the sanction of the whole Court. It is, therefore, desirable to point out these few incongruities, before they acquire additional weight by being confirmed in future cases; and thus to preserve, as much as may be, the general consistency of this depart ment of the law.-another motive for entering upon this task at the present moment, arises from the expectation, which may very reasonably be entertained, that the Legislature have, for a time.
